Dog attack - Ellie dislocated toe - me, broken bones UPDATE

Sorry I have not read the entire post.

But if you received fractured bones from the dog biting. You have a Law case at hand ... (literally)

I was trained at an SPCA in Normal Dog Behavior. This is BAD!
That is the worse bite a dog can give, and where I'm from, originally the dog would be put down!

As well as the fact that I believe this happened on your property!

As far as the insurance thing goes, this is a bit OT but a few years back my mothers dog was out for a walk with another family memeber when he got out of the collar and ran for a busy road he was hit by a conversion van going about 75 in a 55. The dog never had a chance. The person who hit the dog was talking on a cell phone. She went after My family for the damage to her vehicle and was handsomely compensated. SO if the cops say HOI won't cover it they are full of

Call animal control again and tell them you DEMAND a summons be placed against the owners for the dog being at large. Secondly, you DEMAND a copy of the rabies vaccinations paperwork from the dog's vet. if there is no record then DEMAND that they quarantine the dog.

Then, call a lawyer! I am retired now and never licensed in your state or I would gladly help you but trust me...CALL ONE.

Her HO insurance coverage can be put on the tag for it. if she is a renter and has a renter's policy it will without question cover it. My renter's policy covers anyone bitten by dog, damage done to another's property by my dog etc etc etc

Even if the owner's have no money, the potential judgment you will get against him/her/them will be collectable later and will stop her from obtaining many many things. And there are services that take a percentage of the judgment to collect the amount though personal property such as cars etc etc. Not to mention she will be hard pressed to finance anything with a judgment against her.

It may sound cruel but you know what? It boils down to one simple fact. When you own a dog you are responsible for it and what it does. Period. The dog bit you, broke bones and attacked your pet on your property. It is not like you were parading a chicken in front of the dog in the dog's yard. The can lie all they want to, you have a witness, a police report, ER visit and upcoming medical expenses and vet bills. Sock it to them gal ... the time for being nice and cordial passed when they would not help you get medical treatment and began to tell you what is a pet and what is not.

More importantly...if that dog will bite you and attack in that manner without provocation...what child is safe near it? What if a child had been standing near the chicken and not you? Get rid of that dog and if it comes back...darn the law of discharging a firearm in the city (no jury in it's right mind is going to convict you anyway) shoot the darn thing.

Okay, now I am done preaching but I can tell you this...I handled similar cases in Florida and roasted the dog owner's butt six ways to Sunday.

Demand a summons be issued. Become the squeaky wheel. Home owner's insurance will pay. The ACO doesn't know what she is talking about. I would suspect that she is either an idiot or a friend of the dog owner. Speak to her supervisor immediately.
 
Iam so sorry to hear this. I hope Ellie and you both recover quickly. Do what everyone else has been telling you. Don't let them get away with this. That dog attacked you and your baby on your property. I just feel so bad for you I with I lived closer so I could help you. I'll keep you both in my prayers.

OK. I haven't read this whole thread, but have a few things to say. My neighbor has had to pay 2 substantial fines for her dogs attacking my chickens. If it happens again, they will take the dogs away and probably euthanize. (Check your state laws. Ours are pretty specific.)

Pets have no legal standing, but as LIVESTOCK the laws are very clear concerning dogs. This should be approached as dogs attacking/harassing livestock. The laws are specific and harsh for this sort of thing.

As for your own injuries....I would have done the same thing you did to protect your girl.
You really need to get a lawyer. MINIMUM they should pay your medical bills. Moreso, you will need compensation for lost time from work, not to mention on-going PT, etc.

OH... and the Rabies thing....

This is taken VERY seriously in cases of human injury. The dog MUST be quarantined, whether it has been vaccinated for rabies or not. If the dog is unavailable for quarantine (eg ran away, etc) then YOU must get rabies vaccination. Not fun, and very expensive. If the dog is euthanized, it must be tested for rabies (here in NH it is at owner's expense. Again, not cheap.)

A vet will know the rabies laws. It's a shame the police and AC don't.
