Dog attack - Ellie dislocated toe - me, broken bones UPDATE

This stinks! I am so sick of NJ attitude that animal rights supercede humans. Loose dogs are against the law! My large boxer escaped one time (friendly-just running around like a nut) - I did not go back inside ignoring it but ran all over chasing her, brought her home immediately-I did not want her hurt by cars. I then reinforced my fence and made sure that would not happen again.

A year or so ago 2 dogs always escaping attacked someones goats in Monmouth County - they had to repeat attack 2 or 3 times before the dogs were taken away.

Article in paper- man poisons squirrels - goes to jail
Different article- man shoots beebees at squirrels - arrested

Yesterday -Manasquan - dead dog found shot - looking for anyone who saw this?

OMG! I thought our problems were crazy!! DEF lawyer time, and sue their butts off, and is there any way to keep them from getting animals(dogs) in the future? Make a big stink till someone listens!! Take care, hope you feel better soon. I just can't wrap my mind around these stoopid people! I would think a lawyer would love this case---easy win!!

at this point you need to protect yourself - even if its the owners fault for letting their dog run loose.

and yes the owners should pay your medical bills. you are entitled to make a police report - not only will this make you feel better but the NEXT TIME that dog attacks you have a record of it. if the authorities really dont feel like this is serious then a record will help your case and make them take you seriously.

also - its not necessarily up to the officer who shows up to make a determination about the 'crime'. in some places ALL reports are reviewed and send to the prosecutor's office so even if some overworked cop doesnt take your seriously you can get the system working for you.

i know that everyone is all worked up about getting a lawyer - but you might want to try and 'work the system' first. if the dog's owners dont have any money - what would you gain but a bunch of bills? document everything, file a report, start writing letters, take a lot of pictures, and review the dog laws for your area. what is fair may not be what is legal and if your hen is ok you may not be entitled to any damages for her - but at this point its about your injuries from their dog.

just some thoughts

you need to sue them, and use the money to get a new fence, infact get the fence now and when you get the money it will pay for it, get a gun to, legal or not unless I am mistaken you are allowed riffles and shotguns just not hand guns. Go into the police station, file as much as you can if you have not found an attorney yet please do so there are plenty of ambulance chasers out there. All else fails have your friend contact your local paper and leak the story. Take as many pics as possible.

lastly NEVER put yourself inbetween a chicken and a dog again, YOUR health and life CANNOT be risked over Ellie no matter how much you love her.

So please in this order

Take pics get cast put on
Hire lawyer
Contact police again
contact a fence intalling company
Demand to see the rabies paperwork on dog, if not it will have to be collected to test
Document everything you do
Buy yourself a nice Mossburg Shotgun, and learn how to use it, if not get the best air riffle you can at the VERY least

MOST importantly be safe, and good luck with Ellie:hugs

I am so sorry to hear of your injuries and I pray that Ellie is fine! Please pursue your legal options towards the dog owner! Then take on the uncaring animal control then the pd for the non enforcement of dog laws!! This is an outrage!! What if instead of a chicken that was a small child! I will shoot any animal found on my property harassing my chickens! Maybe I should repost the no tresspassing signs and one that says Chickens protected by one old Bitty with a loaded 22!! So keep your dogs locked up!!

Did the officer give you a case number? If not call the PD and get the case/report number. Ask for a copy of the report. In order to get a "full report" you may need to make an Open Records request.

Don't waste time complaining to the officers supervisor, take your complaint to the Chief of Police and if that doesn't get a response then take your complaint to either the Mayor or City Manager, whatever you have there.

Animal Control may not be under the police department. Find out who oversees them and make a complaint too, or include it in your complaint to the Mayor.

It may seem like a big deal over nothing, however, this dog attacked YOU when you were trying to save your pet. That means to me that the dog does not know the difference between killing a chicken (natural instinct..whatever!) and biting a human. Animal Control should have been more attentive to you since you were bit.

I get po'd when cops and the like do not do their jobs. They get paid plenty well and should not make personal judgements on someones pet.

I had a local Mayberry deputy stand there and watch a pitbull throw my chickens in the air but tell me she would file charges on ME if I shot the dog....sorry if my personal feelings are coming out in this. That deputy was a dumba$$ and she was wrong.

You live in Texas? Shoot, not only was that deputy wrong, tell her next time that you are going to enact the castle doctrine on that pooch if she won't stop the killing.

I'm so sorry to hear about this attack. I hope that when you post this morning you will tell us Ellie is doing ok.

I'm shaking my head at the ignorance of people - both the dog owner and the responders from sherriff and animal control.

I'm wondering if you GO TO the animal control place to make a report, if the response will be better?? Perhaps the supervisor has more understanding of the law and the proper way to handle this?? One can only hope!

Keep us updated on Ellie, sending hugs for you and her.

Same here. Especially if it was on your property I would have had a free for all! I do understand that it is a dog but, if it causing bodily harm to you and your animals and if an animal has bitten someone and havent had their rabies shot they are suppose to be quaranteind! That is not right by any means! And you know that if this dog is bothering you and your animals than it is doing it to someone else. The owner of the dog should cover the bills!

b.hromada :

If that dog comes back on your property, would you be able to somehow get it to the pound? Maybe if the irresponsible dog owner had to pay to get it out, maybe they'd think twice about letting her get loose in the first place!

No, they wouldn't. Went through this a few years back. Ppl like that don't give 2 tags about their mutts.
