Dog attack - Ellie dislocated toe - me, broken bones UPDATE

Quote:
I haven't heard of this. I go through Manasquan everyday for work and on my way home. I'll have to look that one up. Where are you located?

Judy - I'm so sorry to hear that this has happened to you again. I'm so glad Ellie will be alright for now. You need to do something drastic here, this is not right. I wish I could help you more, I don't think you are that far from me. Please PM me if you need my help. I'd be glad to go up there to help you out. Seriously. Please take care.

Make sure that's true in the state you're in. Some states both people need to know, some states only one needs to know (you can record your calls to people) and in a very few, I think, no one needs to know (Billy Bob down the road can record your calls to somebody).

Seek out a 4-H club. They do community service and you would, I'm sure, qualify. You could also check with a few churches to see if any youth groups could help if you aren't able to find a 4-H club. And then there's Boy Scouts and Girl Scouts that look for ways to serve the community.

Actually the neighbors can pay for all of this also. It isn't your responsibility/fault that you were bit, and have broken bones, it is theirs, and all actions resulting from that are their responsibility. Bring this up with your attorney. And while he's at it, reopen talks about the flooding issue with the neighbors. He's going to get paid anyways, and may throw that in the pot also.

Keep a written documentation OF EVERYTHING. Who you had to hire to do things while you are injured, how much you paid. Every person you called, how long you spoke to them, what happened, etc.

I would also get a letter from the doctor saying that these were obviously wounds from a dog and the expected medical cost alone will be:_________

Chicken or no chicken in the yard, the dog was in YOUR yard and attacked YOU.

Sounds like you have a run of bad luck. Sounds like you need to contact some local media--1. have them investigate the problems with your neighbors that is causing problems on your property 2. the dog thing.

I don't know about other states, but this is true in Kentucky. Only one party of the conversation needs to know.

you're right --- i have never been in a lawsuit --- hopefully i never will

good point --- if they are willing to perjure themselves once for someone elses benefit - they would be willing to do so again for their own benefit

sad times when people can't settle stuff between themselves and need a mediator

If it goes to court, the dog owner's HOI company will have an attorney that will specifically ask about any conversations with JJ. The attorney's job is to minimize the cost to the company, not be fair to JJ. He/she will be sure to misconstrue anything said, and they will advise the dog owner to do so too. I am personal friends with more than one personal injury attorney and have asked them about this. It is a common practice for people at fault to claim that the injured person said they were OK. They try to use their words against them in court. When you are talking about money, negligent people tend to let their honesty and morals fly out the window.

This case will never see a courtroom. I can pretty much guarantee that they will try to settle this out of court. Juries now a days are giving out HUGE verdicts, especially when a large dog is tresspassing and BREAKS bones while doing so. Pretty clear cut. The other side will sure sling some mud, but in the end, their HOI will advise them to settle and NOW.
