Dog attack - Ellie dislocated toe - me, broken bones UPDATE

Quote:
I hope for her sake you are right. If it goes to court, it will really drag out for a while. Settling would definitely be the easier route.

Easier yes but one thing that I have not heard mentioned is the possibility of future problems with the hand.

I have a friend that broke his hand 20 years ago and it did some nerve damage to it that didn't immediatly show up. Something about the callous on the bone that happens during the healing process closing over the nerves. Like Carpel Tunnel does. Anyway he has to have surgeries every few years to help with that damage.

Since he had settled the claim and didn't leave it open for future damages he has to pay out of pocket for treatment. The health ins. won't pay up because it is a pre-existing condition.

Get a lawyer! I f anything calls for it, it is this?!!! Neighbors dog and now you have broken bones and a injured pet. File a formal complaint with the police. ErinM

Judy, sue em for a new puter for me because I've just flooded this one out crying for you and Ellie.

Did you take pics of the blood on your friend's pants?
make copies of all the doctor's reports, Xrays and stuff like that...
Print out the NJ laws on harrassing animals...

I am SO angry right now I could spit nails!!! Between the attitude of the owner and the cops...

I KNOW that neither of us can have guns, though I wish..I'm so sorry that it happened again and even more so on a busy weekend...crud...typical though.

I so wish that you were my neighbour..I'd kick butt and take names...

Hugs to you, Ellie and BJ.

Is there a leash law in your area? I'm not sure where you live, but this is horrible, I haven't read thru every post but did read what happened to you and this is so sad. I hope you are recovering from your injuries. I am a owner of 6 dogs and I would NEVER in my life say something as ridiculous as that to someone! For one the owner of the dog should be keeping the dog where it isn't running all over the neighborhood. Where I come from if a dog kept doing something like that, there would be no more dog! And for the dog to do this to you and no one do anything about it is ridiculous, I'd get a hold of the law enforcement and then contact a lawyer.
Apologize then say BUT, what is wrong with these people?
Again I hope your healing quickly and I hope that justice is served on the owner of this dog! You do have a case! I know a person in my area that had something similar thing happen and um he got a lot with that case!

JJ- I will be thinking and praying for you, as well as Ellie. It is so good to hear that she is doing better!

hi - and thank you all for your uplifting, helpful notes

i am going to read them again closely asap to make sure i answer any questions that you kindly took the time to ask. thank you also for knowing just how i feel about my babies and being just as frustrated re: how irresponsible and outlandish the people involved have been so far.

a little update - i have renewed concern about ellie as it appears her middle toe on the foot she's been holding up is broken/dislocated .. some swelling too. HOPING ITS NOT AS BAD AS IT LOOKS, THAT IT WILL IMPROVE and that the vet did not miss this -even though the look of it is not right and she's holding her foot up a lot. getting ellie back in a carrier with only one hand is pretty impossible, taking her all the way back to the vet, and worse, after losing days i wonder what hope would there be for proper healing? the toe seems to have 2 'bumps' that i don't see on the other foot's middle toe, at approx 1/3 and 2/3rds up and it seems to kind of wiggle to the side when her middle toe on the other foot stays steady,,,she does walk using the troubled foot when necessary but i imagine it really hurts. so i wonder.what can be done days after the fact if it isbroken or dislocated (if that's even possible..)...

i worry that herability to move fast when the need arises may be forever compromised.. hopefully it's just really angry but not broken/dislocated.

the aco left a message friday that she was delivering 2 tickets to the dog owners (dog at large and not sure about the other one - maybe re: my injuries) - unfortunately, given her attitude i am concerned about what she said to them and hope it wasn't 'dogs will be dogs, they were just chickens, and she shouldn't be taking it this far'. her message said she also wanted to drop something off to me aswell as relay something. i wasn't home (was being driven on a couple of errands) but returned her call promptly, got voice mail and said she could just leave the info for me. but i never received anything.

i have attorney appt tomorrow - pulled their number out of the book pretty randomly - not sure the best choice but we'll see, having never sued anybody before i didn't really know who to call.
i do know that my hand is fiercely angry - precious little sleep since this happened wednesday..and so little getting done......yet so much needing to get done. unfortunately my good job ended a few months ago (a nonprofit that lost its funding) and i've been temporarily in a very low paying nonprofit job looking for the opportunity to get back to decent pay so if my current salary is used to figure any loss of work, it's going to be strikingly insignificant. murphy's law.

more later - thank you thank you - eager to reread posts asap...
