Dog attack - Ellie dislocated toe - me, broken bones UPDATE

Judy, she may have a broken middle toe. My Buff Brahma broke hers in exactly that location. What you have to watch for is that, with swelling, it hits the ground more and she can develop bumblefoot right in that location on the bottom, just like my Caroline did. Her toe still is larger than the other one, but she does fine. It healed on its own. We treated the bumblefoot infection and bandaged the toe, sort of crossing the bandage around the toe, then crisscross around the back of the ankle area.

Ditto what Jody said. You are in my prayers.

Back from the lawyers. While I have never done this before I understand technically why it is necessary- it sounds as though a lawyer letter iswhat will trigger their homeowners insurance to plug in. Even if I wanted to, the attorney told me not to return the dog owner's call. I don't know where all this is leading but at least someone is helping me, as I am really compromised trying to get things done one handed.

I placed a call to the vet this morning about Ellie's likely toe fracture - no return call as yet - typically I have to call back as they rarely do

.

While I was out the ACO left a message that the Chief of Police decided there will be no police report, that the ACO's report will suffice. She also wanted to drop info off and I again left her a message saying to please do so - so far she hasn't. Theattorney didn't advise me re: the rabies/quarantine issue but the ACO made it clear they are not considering it a dog bite case - we had blood, scratches, saliva so I still think cautions are necessary -

While I was typing this I got a message from presumably the dog owner's insurance company, asking me to call. I may run this by the attorney before returning the call.

That may be all for right now... my poor babies want to get out of the run so bad (it's shady and cold and they want to bask in the sun) but I can't let Ellie out while she and I are both compromised, if ever.

Do NOT call the insurance company. They will attempt to use your words against you. They are experts at it. They are in business to make money, and the less they pay out the better they like it. It is more dangerous talking to them than it is the dog owner. Let the attorney call them!

If the dog owner or the insurance company ever calls and you answer, just say, "I have turned all matters regarding this over to my attorney. Please call him at XXX-XXXX." And say no more. They will say things like, "We just want to make sure you are all right," or "We would like to take your statement." Then they will turn your words against you. Just keep saying, "Call my lawyer, not me." Let the attorney earn his fee and protect yourself.

Your neighbor is responsible for Your bird's injury/death because the birds are your PROPERTY.

Your neighbor is also responsible for YOUR injuries because his/her dog entered YOUR yard and did YOU bodily harm.

Contact a good trial lawyer and sue him.

My husband is an attorney. PM me if you have any questions.

I am so sorry that this happened to you. You are not responsible.

thx! will do! sent e-mail and phone message to attorney that they had called, and provided him the contact info, asking what i should do. (and now i know - don't call!)

I am so sorry for you and Ellie!

The response of the dog owner, animal control, and the Police would have me calling every supervisor I could find. If they fail to act, go above them too!! Good lord, you help pay their wages, and are a citizen of that county/city that they are suppose to serve!!! This is just unacceptable on all levels. I hope and pray everything works out for you, don't give up. Raise a heck of a stink!!!!!
