Dog killed a duck, I asked for $50....

For the record I wouldn't sue over a duck

For the record, I would

I would go to the Holderread website and figure out how much it would cost for an adult bird PLUS SHIPPING and that's what the claim would be.

I dont know about your area but be careful throwing out a high number in this case. We have known a few people get in this situation and typically 10-20.00 is fair for a grown hen. Unless you have something very rare and can prove the cost. Either way they owe you money and need to keep there dog up.

Oh and also around here you have a choice of either collecting the money or letting the county put down there dog. They believe a dog that kills livestock of any kind is not worth it. Look into this and it may help change your neighbors mind about being so ugly with the situation.

Me too. I have a very low tolerance for stupid people and an even lower tolerance for loose dogs killing my animals. BTW the dog owner is either an idiot or a liar (probably both) because only an idiot would pay $3000 for a dog and let it run loose. Actually, even if it was free, only an idiot purposely lets a dog roam.

If there is one available in your area, great. If not, Holderreads. It is not always easy to find a laying age duck when you want one.

What the hell kind of dog is worth $3k? I have a purebred Papillion which is among the best standards for her breed and only paid 1k for it. I was iffy to pay even that much for an AKC registered, pedigreed dog.

I'd sue for $50, hell if I caught the dog back I'd shoot to kill and sue for damages to coop as well if there are any.

$3000 dog, my big old ..... I live out in the country and everybody who owns a "huntin' dawg" thinks it's worth $3000. Tell him to sell the 3k dog and pay you the fifty; he'll have $2500 left over and won't have to buy dog food anymore. He'll make a profit on the deal. I'm with whoever first said "you can't fix stupid"!

That guy is a moron and a liar

We DO have $3k dogs, several worth quite a bit more than 3k, and you can bet the farm they stay locked up in kennels and our dog barns unless they're working or we've got our hands on them.

He needs to pay up (and I think $50 is fair for your duck) and pull his head out of his rear AND keep his "expensive" dog at home. His dog won't be worth much after it's dead and burried

LOL, I don't believe the dog is worth 3k, not for a second. It's a beautiful dark brown dog with white markings, could be AKC but I don't know that much about dogs. Could just be a random pup from someone's unwanted litter too. I love dogs, but a random high number pulled off the top of ol' boy's head isn't gonna make a difference when it comes to compensation.

I talked to the sheriff and they told me that if he hasn't compensated me within a reasonable amount of time then I should make a report. I am going to give him one week to pay up before I make a report. I'm writing down a timeline of events right now.

Thanks for providing that link to Holderreads....I told the guy I'd itemize to show him that I'm not just throwing a number out there, so we'll see if he thinks $50 is fair after seeing the Holderreads price tag and the actual cost of raising a duckling to laying age....

Based on what I could tell, that is at least $73 including the shipping box, possibly more.

Hopefully you have photos. If you didn't file a report you should.

Personally I would be inclined to give the neighbor only a reasonable time to pay, then I would find out how much small claims court filing fees are in your area and if there are any fees to have him served a summons. Add $73, filing fees and summons fee. Then let him know that you were trying to be generous about it at $50 but if he doesn't pay for the duck you will take it to court and it will cost him whatever the total of those things are. Give him a reasonable deadline and let him know that once you file you will have to follow through but you'd rather just settle it between you two. I think if he knows your serious he may be more willing to keep his dog home too.

Then consider actually filing in court if he doesn't pay the $50. If you have reasonable proof or even just come across as the honest one you will win. If he doesn't show up, you win. Small claims courts don't have a problem awarding reasonable damages plus fees.
