No, I don't believe the mother and the owner of the ducks live together. I am under the impression they live next door to each other so she technically is not the spokesperson for these ducks. But he did wait about 10 days to look for the ducks and ask my friend about them.

I told my friend that I was not willing to call the man nor just give him the ducks back. They blended in quite nicely with mine and appear to be quite pleased with their new digs. These are domestic ducks that he had just turned loose on his small pond on his property. No fence, no enclosure, no safety from dogs or other predators. They had continuously left his property, played in a big, water filled pothole on that busy street and had been chased by neighborhood dogs. Their fate was obvious.

Well hopefully he won't bother to call...TEN DAYS before he tried to find them?? Wow....if I look out the window and think someone is missing from the pen....I go look IMMEDIATELY! And my pen they can't get out of....sheesh....Guy sounds like a real loser...I would say demand money for their care and make it STEEP....yeah, I wouldn't want to give them back...maybe he just won't call.Keep us posted...
 
Some friend that is. She stole those ducks, gave you stolen property, and then ratted you out immediately. Watch your back around that one.

The mother had no right to give away ducks that weren't hers. So your friend took ducks that weren't hers without permission. That's theft.

They aren't your ducks. They weren't your friend's ducks. They weren't the mother's ducks. If the owner of the ducks knows you have them, (and he does, thanks to your "friend" ) you must give them back if he asks for them.

If he decides to press charges for theft of livestock, the judge isn't going to buy it if you claim that you won't give them back because he won't take care of them. Legal avenues were not followed. You don't get to take the law into your own hands.

Sorry for you, sorry for the ducks. Hope he doesn't call you, or at least will agree to give them to you, or sell them to you for a small price.
 
By the way, you can't charge him board for storing stolen property that was taken from him. Not under any circumstances, but doubly so since you know the ducks were stolen.
 
Legally they belong to that guy. They are his property. Ask your friend to play dumb. No clue about the ducks.
If he gets your number and ask for the ducks, then you do have to hand them over. You could try to get some money for boarding, but your chances are not that good at all. You could also try the line of that they are not being kept properly and animal control perhaps should take a look at it.
Overall, it is best to just say nothing to the whereabout of the ducks. You can always say they where given to you and you don't know if they are his indeed. The has to proof is now on his end. Looking for leg rings etc...

p.s. thanks for all the suggestions. I wish I could have kept them (they are picking them up tomorrow) I get attached really quick. But I can only hope they will do what is right for the ducks....

Give them a show around of your place and educate them. That way they may give the ducks to you, if they feel it is best for the animals. You can catch a lot with just a little bit of honey. German saying.
