Point is... lock your birds up and protect them from any and all possible attacks, first.
As far as legal options, I'm sure you have some. Whether they get inforced in your area or not is different. Here... it depends on who you are. No, it isn't right, but that is the way it has always been and I'm sure I'll be long gone before it ever changes.
