Fences dont always make good neighbors... Pics at 11

Maple... in the pic of the plat, the fence will be on the solid line on the right side of the pic as you are looking at it.


and where is thier home in relation to the pond? They are coming from the south..walking around the pond across your lot to get to thier side and the reason being? I take it from the photo maybe there's too much overgrowth for them to access it safely from thier side?

Using the plat for reference, there home is at the very bottom of the plat, near the barn. So they walk up the access road/my driveway and just before they get to the pond, they hang a right and walk the length of the pond on my property to get to theirs.

I really don't get someone getting upset about someone putting a fence on their property. Now stomping across my lawn...that's a whole 'nother story!

My property is everything inside the solid lines. I also marked the pond and used dashes to show the access rd and dots to show the footsteps across my yard...lol
 
So their easement basically is a 50' wide swath along the access road to the pond? Usually stuff like that is measured from the center of the road, so if that's how it is they have 25' on either side of the road from it's center. If that clause for the easement was contained in the contract when you bought the place you probably can't do much about it. Are they not following that path? We retained an easement to one of our fields when we sold off a house that was on that piece of ground. First owners that bought the house, there were no issues with, but the next people who bought it weren't happy about it, but it was written that the easement passed from one owner to the next and whoever bought the ground had to continue the easement. It was in their contract that they signed so they had to abide by it.
 
I am now even more confused. I thought on the first pic of the plat you say the fence is going on the left side. Now you are saying it is on the right side. I will have to go back and reread. If it is going in on the right side from top to bottom, that makes absolutely no sense to me. Why in the world would they be fencing there? That would be like fencing you guys in with them. I can understand if it is on the left because then the fence would be between the houses, wouldn't it? Why would they fence the other side unless maybe they are planning on selling that side? Again, I'd recommend just talking to them to see what they are up to.
 
It makes no sense why she EVEN has to walk across your yard at all!... she needs to walk across the road and walk around HER property...
I'm betting that the easement is only for the road area... not through your whole yard...

That stinks, I wonder why she feels the need to fence it, hopefully she will not put up a privacy fence so it will still feel open. It would be nice to convince her to put in her own path on her fence line rather than having to use your property, I know I would because I hate invading anyone's space or privacy. I think I would take the advice of cleaning out the pond of the desirable fish until they no longer used it! Oh, and if she fences her side she will not have access to your side to the pond, so how will that work walking through your property?
