I would suggest that you photograph and document the grave. Make copies of the photos and grave marker information. File a copy each with your local genealogical society, historical society and genealogic section of the library.

I have a full cemetery here. I also grew up with small clusters of graves on our farm. You can look for him in Revolutionary Soldiers Rosters. It is a mystery to solve. Please don't let him be forgotten. Local probate records are your friend.

Check out Findagrave.com. They have a lot of information of gravestone preservation and photography. You can even put your cemetery and stones online if they aren't already there.
 
that is really neat. But I have a few questions.

1. Is that are no longer usable? It's someones final resting place and you wouldn't want to desecrate it. But now you can't garden or put up a coop or anything there right?

2. Can the historical people come and snatch your land?

3. Since you have proof that someone was legally buried there can you now use it as a cemetery and possibly bury your own people there?

Very cool, especially if related! We don't get a lot of that in this part of Minnesota since by the time the state was settled there were lots of public cemetaries established then.

I did find out though you can be buried on your own property here if you aren't embalmed and buried within 24 hours.
 
No, no one can take her land but she can not move or touch the graves. This same thing just came up in the state of Vermont, someone bought a big piece of property and where they wanted to build their house with a view was an old family cematary plot. So they wanted to move it. To make a long story short it went before numerous boards,they got a lawyer and all that goes with that and it was voted down, the cematary was to stay where it was and they had to build the house somewhere else on the land. Every state is different of course but it is very hard to legally move a final resting place as I have seen it come up from time to time.
 
For the ones you cant read, try taking a piece of large paper, like kraft paper, and holding it tight against the face, then use a piece of chalk and rub it on the paper. It will make an image of the stone onto the paper, and be much easier to see what is written, or least you will likely see more than just looking at the stone.
 
Unbelieveable huh???? They wanted that particular view from where the plot sat. It would never fly for moral reasons but they also were from out of state....lol
 
I wouldn't care about the view, I'd be freaked out that I was building on graves! I worried about that when building my house!
If I were them I would build else where,
and made the cemetery a garden and fixed up the graves!
