Ok, Ive posted on here before about my dang neighbors but looks like Im gonna have to go legal on them. The kids are riding thier ATV's thru my yard again. Its on the easement for the state, so they think they can get away with it. Im also pretty sure someone next door tried to steal my game camera last wed. Good thing it is padlocked to my tree. I have pics of the little bleep<daughter> riding thru my yard during the day, and at night, when I stopped her because I saw her going past my mailbox, backing up, and was going to ride up thru my yard.
Does anyone know if I have any legal recourse to put a stop to it? The sheriff just says to put up No Trespassing signs. Im not home all the time but that doesnt seem to stop them. They know they arent suppose to but they do anyway. I was so mad I went up there to bleep out thier mother but nobody was home. I also have pics of thier dang dog crapping in my yard again. I so want to SSS it but they'd know who did it. I just dont understand why they have to be such bleeps. Its the kids, not the mother, but I know she knows what they are doing. Im gonna have to talk to a lawyer, I guess.

Honestly, I think a lawyer would be a little much. Just notify their parents and make sure they'll do something about it.

You need the No Trespassing signs; they serve as notification that they are not allowed on your property. Without there being notification, law enforcement probably cannot do anything, or nearly as much as if you have signs.

However, you DO need to adddress this with their parents--preferably talk with her and say, Look, I know your kids enjoy their ATV, but I do not want them driving on my property. And I alsop want you to keep your dog off my property." If that gets no results, send her a certified letter stating hte same thing. Step by step build your case. You can take it to an attorney if you are still getting no results after posting signs, speaking with the parents, writing the parents and calling law enforcemnet when they trespass.

Ditto what Sonoran says. I would also get the signs up and when you talk to the mother tell her you are not going to bne held liable for her kids if they get injured on your property. The signs help cover your butt legally.
Do you have a way to put electric wire up around the property? Tposts and 3 strands of wire to zap the dog amd put up the warning sins so the kids can see them and the fence would work for them also.

If it is an easement they probably have the right to use it.

Why is it most, not all, have such a problem with everything...neighbours, kids, taxes, inflation religion, and everything else....dang, can't we go talk to people and work out our problems...since when does everything become a crisis??

HarlansHollow I have an easement going through my property. Right down the middle. does that mean my neighbors have the right to come on my property? Depending on the easement no it doesn't. And it really doesn't give someone a right to go driving vehicles through another persons yard.
I may be wrong but I read it as the easement was the states not the neighbors and that doesn't give anyone but state workers the right to come onto his property. I am sorry but I don't want just anyone on my land. I had a snowmobiler run over a chicken a few months ago. is that right? He came right through my yard hit her and kept going. He also took out an aple tree and walnut tree that I just bought last spring. So now I have to buy 2 new trees for $60 plush shipping and that's not counting the pet hen. You know how hard it is to tell a 7yr old that her pwt is dead?

We too have an easement but it's for utility workers only. We're out in the country, and one farm backs up to another. We can't completely fence in the property because utility workers (electric) need to be able to get to the poles which are in the back of backyards. Still, we get people on horseback riding through our yards. When we can afford, we'll fence ... leaving a 6' easement around perimeter of the property.

So, NO ... people do NOT have a right to use state's easements for their personal ATV course.

Harlans: It's not a crisis to YOU because you don't have ATVs and snowmobiles and horses creating havoc on your property and running over your chickens but believe me, when you've got a problem like this, you better believe that BYCers will be there for YOU.

Our neighbours also have an easement, we built our fence, put up a gap with a hot wire, and according to our agreement we both have the right to go though. Check the paperwork.
If your neighbour/state allows it is probably legal, if that is the wording in the easement.
As far as your chicken and your yard...maybe try to be a good neighbour!

this is an open forum, people post their problems to vent, and to seek out support. It is a good way to get ideas, suggestions and to simply find a community of fellow poultry lovers who often understand their/our plight and often run into the same problems. Sometimes it helps just to rant and blow of steam and hear others points of view. Especially when a person lives in a rural area where it can feel isolating.

The OP isn't cursing, or being rude, or hurting anyone, leave Rammy alone. If you don't like people venting don't read the venting posts, instead of reading the posts then complaining, about how other people complain.
