Got a Knock on the Door Today...

Believe me, as soon as we can afford it, we're moving to the country. I feel like I am being punished because we can't afford to buy our own place right now and we have to rent. So what? We don't own the property, but we own the property inside the property... That has to count for something! I do not like this AT ALL, although I do have a feeling it's legit. The town we live in has a population of a whole 2000 people so the crime rate isn't prolific, even still... I will be making the suggested phone calls just to be sure. Better be safe then sorry!

U.S. Constitution: Fourth Amendment

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Even vampires can't come into your home without an invitation.

I agree with others that said not to allow them entry. My husband worked as a city code enforcement officer after he was injured as a firefighter and put on a desk job. People always had the ability to tell him to pound sand and get off their property unless he had a warrant, though most people didn't realize it. You do not have to allow them onto your property whether you own or rent. I wouldn't let them in.

ETA: They will almost certainly make it sound like you have no choice but to let them do what they want, but the fact remains that unless they have a warrant they can present to you, you do NOT have to let them onto your property.

Hope it goes well for you. Lock up the animals. Would hate to read of a kitty getting loose,or a dog being shot for biting one of those inspectors.

I would want to move too. I went through something similar when we lived in a condo. I had no idea they were spraying pesticides in the homes when I bought it.Tried to stop it due to toddler/pregnancy risk, but in a the end the police were at my door backing up the management company. We bought and sold the place quickly.

A troubling thing I have read about is NO-KNOCK warrants. Way to many innocent people being killed when people raid their homes, and they ofcourse react defensively to people *breaking in*.Really sad part is most times the reason for the raid(drugs) is found to be not true.

I used to think no one could mess with you or your home, but if they get the *right* paperwork you are out of luck!

I say get them in and out quickly and then move soon.

Well, I have called the landlord (who happens to be the pastor at my mother and father-in-law's church, he's an awesome guy) and he says that the city has the right to do an annual inspection on the property once a year. He did, however, tell me that I have a right to hours notice, and if I want to call them to reschedule, I can.

What good will that do me? I've already stressed myself sick over this since 4:00 yesterday afternoon. No point in putting off the inevitable. I do have the best SO a girl could ask for, he has cleaned the ENTIRE house, spotless! So, I guess now we just wait... Wait for some stranger to come perusing around the house. I can tell you of ta list of things that are going to happen today, for sure...

1) NO ONE will get into this house without the proper identification.
2) I'm gonna be hovering, uncomfortably if I have to, in order to insure the safety of my belongings and cats.
3) As soon as this is over, I'm having a big, cold, glass of wine. PERIOD!

Ugh, I have literally worried myself sick over this... I just want it to be over.

Just a thought, but you may not want to post about shooting a city official if they let your cat out....just sayin...

They're more looking for landlord infractions then whether your house is messy.. this would be more like a home inspection for faulty electrical, leaky plumbing, and a good time to complain about the house if you have any. (some people have sucky land lords). Still, check for credentials and put your **** gun away less you want to risk loosing it! Some things should be kept handy, but out of plain sight.

Have you researched to find out what this ruling allows? Maybe they are over stepping their bounds... If it bothers you so much, you should find out what exactly the purpose for the inspection is, and what the wording of the ordinance or inspection in tails. This way, they cannot overstep their bounds. You may have the option of not allowing them inside.

I have a rental inside city limits. A few years ago the city passed
an ordinance about rental propertys to contol "slum lords".

Just another piece of paper that costs me $50.00 a year.

The city has a minion do a walk-by. Whatever they see from the
outside I guess. I'm not aware of them ever being inside. Pretty
sure I would know, we have a blind lady living there and she calls
all the time.

Last year there was a big push for people, rental and home owner
alike, to make sure their section of the sidewalks were okay. (not
raised up, broken, missing sections and such)

Yep.

It does not matter what city or state you are in. Nor does it matter what the ordinance says. The fact is that you do not have to let any government agent on to your property without a warrant an you should never let them without one. Having nothing to hide is not a good reason to allow your rights to be violated.
