Got letter from Town to remove my chickens from my property

Sometimes there are lawyers that will take on cases like yours pro bono, especially because it likely wouldn't cost them any court time, just letter writing, which their assistants can do...it's worth it to make some calls...

You say that it's a zoning issue...are there zones within the city of Gilbert that DO allow poultry? If so, and I were you, I would try to contact as many currently legal chicken owners as I could and solicit their help in changing the ordinance for your zone. A group will get more attention from the city council/zoning commission than any individual.

AWalker3, thank you, yes there are chickens aloud in other zones. I was hoping to find more local chicken lovers here in this forum that would team up and get codes changed. Not sure how to find them other wise. It is ok to have chickens with lots starting at 8000 sq ft those are so called zones SF-8 and up. Since I am in a zone SF-6 (even though my lot is just shy of 12000 sq ft) the lot sizes start at 6000 sq ft. Which is still plenty of room for a small brood to house.

Hope to connect with some local Gilbert AZ chicken lovers

I took on the city council here in my home town before I got chickens. Half the council supported legalizing chickens, the rest didn't. I found many chicken owners and people who supported me, but when it came time to show their support they all stayed quite. On the other hand, the residents who opposed chickens spoke up loud and clear! I was demonized in the local papers, and eventually the council punished me for stirring up the public. I finally told them to stick it in their ear and I started a flock. I have a privacy fence around my property, I don't keep roosters and I only keep six hens. I share the eggs and stuff with my neighbors, so they don't mind my birds. They are happy and quiet. But just one complaint will put me in the same situation as you. Wish people where not so hard headed! Oh, and get this. I can legally raise pheasants but not chickens!!

If you cannot get the ordinance changed, another option since you have such a large lot, might be to request a variance. They are sometimes granted on a case by case basis. If you have met any requirements for poultry from the SF-8 ordinance such as set backs from fence and buildings, number of birds, cleanliness, etc, you might have a good shot.

Good luck and I hope this is resolved quickly and easily for you.

if things dont work out wait 1 month after things cool down build a peivacy fence and keep hens only and muscovys no one will notice i used to have chickens but mistagenly got a roo now i had to give em up cause they are illdegal now im trying only to get hens and keep them under privacy and share with my neighbor and close friend some eggs if a tree fall in the forest and no one hears it no one would care LETS CALL THIS PLAN B

Serama Rooster,
yes I have muscovy ducks, love them. But the one Mallard lets you know when she is hungry, still nothing compared to dogs barking. And yes the rooster was amongst what I hoped to all be hens and he will go. But I will fight for my chickens and muscovies. Will keep plan B on hand am in process of planting lots of trees to buffer sound as well. :)

good idea about the tree and also have bird feeders on the trees so lot of bird would come and drain out any noise
