I'll give you some more clues since it's an action shot.

Short--no more than 14.2, drafty, German origin. Has a brand in the shape of a pine tree.

Well, I guess that's pretty likely now that I think about it. If I'm not mistaken, the usual presence of the Champagne dilution gene is another thing that makes the Black Forest horse easily distinguishable. As far as the Conifer tree-shaped brand, Thuringens also have that.

You are all correct about it being an Icelandic...
Look at the coloring of this horse, it is perhaps a 1 in a lifetime type of genetic anomaly.
The horse is a chimera, the dam was carrying fraternal twins, but the other twins DNA became entwined. This horse has chestnut pinto markings AND black pinto markings..
This is vastly different than a tri color paint or pinto that is a bay or roan.

A bay or roan is not a true tricolor pinto, 'true' tricolors are quite rare, like this guy. That second pic would also classify as a tricolor. Brindle horses are also generally chimeric.
