I sell hatching eggs on ebay, and thru personal contacts.
The incubation, the shipping, the raising of chicks... are all out of my hands.
Fertilitly should be good in a specific pen before ANY eggs are sold from that pen. A breeder should have a hen in the pen he is selling from at least three weeks prior to selling eggs from that pen.
AND you cannot move hens around during breeding season (if you are going to sell the eggs)
It is the SELLERS responsibility to pack the eggs safely and FRESH ONLY. Then take to the P.O. promptly on a monday or tuesday.
After that it is out of my hands.
Some breeders dont know the rules.
Like always refund if something stupid like that happens. Immediately.
It is bad for your reputation to do anything else.

It may just be a matter of (excuse me for saying it bluntly) ignorance on the part of the breeder.
Wrong breed or color is breeders fault.
Bad hatch is not really anyone's fault. could be incubatEr or incubatOr or Post Office or chickens.
Not saying what to do, but the breeder should step up to the plate and offer something to help.
