Well, there is an appeal process which I will utilize if I need to. This is the second time in the 10+ years I've been on ebay this has happened. Last time, they ruled in my favor...so here's hoping for a repeat!

Well, they sided with her and gave the reason as I sent her damaged items. I'm beyond ******. I am appealing their decision.

"I shipped fertile eggs to her. They were damaged in the mail by the post office. Then she asked for me send her more at my expense, I told her I would send her FREE eggs but that she'd need to pay for shipping or that I would refund her money for the eggs but not the shipping. She threatened me with negative feedback (which should be against the rules!??!) and opened the case against me before we could even work it out with her! No one can guarantee that eggs will hatch once they're shipped. Especially across the country from Washington State to North Carolina. I tried to work it out with her and I'm confused on why she was able to get her money back if I shipped her eggs the next day and it's no fault of mine if the post office crushed them! They were packaged well, in a new box, marked FRAGILE and the post office noted the damage upon delivery. If they were obviously damaged, she should have taken that up with the post office and not signed for the eggs! I looked at the PayPal shipping information and the postal service put "VISIBLE DAMAGE" on the notes section when it was delivered to her. So the box was damaged in transit. She even emailed me and told me it looked like the box was crushed in the mail. She threatened to leave me negative feedback and has been harassing me since. Lastly, my auctions all state that I'm not able to guarantee hatch rates. She bid anyway and now got free eggs out of it and I'm out the money from my own pocket on shipping eggs to her.

Oh my god! really!!! That is the stupidist thing ever! That just irritates me! she know the risks! sorry, but i bet shes just trying to get free eggs! I wonder if she has a brooder full of what ever the breed was!

I agree with redhen. She is probably playing you. Her earlier e-mails were just preparing for her subsequent actions. Her eggs may have arrived completely unscathed.

eBay sided with her, took the money out of my account and she got it. I have appealed their decision but haven't heard back. When I tracked it, USPS had a note that it damaged (the box.) again, how is that MY fault? The eggs were fresh, fertile and the box was new. It was clearly marked.
