I need advice, no one else to ask...

Thanks Redhen. If she sends me vet papers proving that the cat was actually that ill (or brings them here as I don't live that far away), I have no problem giving her back her adoption fee at all.
My issue is that I told her flat out BEFORE she supposedly racked up $500 in bills that I would pay the bill only if she put him down (she told me he was dying and I didn't want her to make him suffer trying to get him to pull through if he was that bad) because I wanted to and felt horrible. I told her that I could not afford to pay hundreds in bills so not to come sniffing around for it. Then nothing for a week and now BAM there's $500 in bills and if I don't pay up I'll be hearing from her lawyer.
Well I'm not e-mailing her anymore. From now on I want letters in the mail or nothing at all.
We'll see if I actually hear from her.

i think you will be fine then!...do you have the e-mails with you saying to put him down?..keep them!...i dont think she would have to hire a lawyer for small claims court...so...just..keep those e-mails!..they will be what saves you, i believe......and..you are right..DONT contact her anymore!....i really dont think she will do anything though..good luck!

Yes of course, I have every e-mail from her going back to before she even filled out the adoption application.
I don't know if I could ever use my own husband as a witness for anything but he was here when she came and took him and while we were talking about his injury and the remaining meds and that she saying it would all be fine, she still wanted him, etc.

I am so sorry for all your trouble. It is hard enough to be a responsible animal owner with out all of these ..........well, you know what I want to say. Chicken lady gave you great advice. You are in the right. In addition, I would get a statement from your vet.

Good luck and stop worrying. Easier said than done but as you can see by all the posts, you have absolutely nothing to worry about.

I just realized something, though I'm not sure if it would hold up or prove anything.
The adoption application she filled out finally when he was like 2 weeks old says:

Kitten you are applying for? ___________

In the space she wrote "Orange male with pink eye"

And she signed it.

Yes, he did have a bad case of pink eye that took multiple treatments to clear up, which was why he was on meds again when she came to get him...

But doesn't that prove that she knew something was wrong with him?

If she does send you a bill...make sure it is an original itemized bill. She could just send you a paid receipt for $500 and you don't know if that was spent on your animal or not. I'm not sure if I would give her the adoption fee back if she doesn't provide proof of a vet visit. Giving the fee back could be viewed as you acknowledging that you did something wrong, which you did not. I think she is full of it, and wouldn't lose any sleep over the issue. Don't give it another thought until you see positive proof that there actually was a vet visit and charges. Good luck!

Will do. Thanks everyone, once again. I'll keep you all updated on what happens. Hopefully I never hear from her again...

Call the law school closest to you and ask if they have a legal program that the soon-to-be attorneys visit with you for free. They did at the college where I went. Do you have a friend/neighbor that can give you some free legal advice?

Second, she could have returned the cat to you right after she took it home if she was worried. Rather than incurring all the expenses (that was her choice). She chose to follow through with treatment for HER cat... You were honest about the kittens problems, and you completed the transaction in good faith.

You could threaten, I suppose that if you have to pay for the bills, you want the cat back too, especially if you are refunding the adoption fee....

People like that are the reason that there are not more rescues or helpful programs.

We used to do $30 spays and neuters at the clinic that I work at now (We are a high end practice and were offering this service because no one else would.) We would schedule 1 spay or 2 neuters every surgery day and only charge the $30 to cover supplies and drugs.
All went well until this man brought his 9 year old female obese yorkie in that had an elongated pallet and collapsing trachea. He also had his male yorkie in to be neutered. The male had passed the physical and was given a mild sedative to make waking up from surgery easier. The vet in surgery that day called the man and said that we really needed to do bloodwork and IV fluids for the female (additional $45 (we gave him a discount on that to))
Next thing we know the man is in the lobby screaming that we were abusing his dogs and ripping him off for money (he was obviously drunk) We brought his dogs out to him and informed him that the male would be sleepy for he next 1 - 2 hours and to please take his business elsewhere. We ended up calling the Police and they escorted him away. He tried to sue us for $30,000 for emotional trauma and discrimination (because he was jobless)

and giving his dog drugs to make him weak. It turns out he has tried to sue about 8 other businesses in the area (non succeeded).

The upper ups got rid of our Spay Neuter program after that little scare. His selfish scammy behavior ruined it for hundreds of other people who could have benefited from our program.

I wouldn't worry about this lady, I am sorry that the kitty has a $^&$% for an owner but you can only do so much for them. I would have to agree about contacting a law school or even a firm and asking where you stand in all of this. I am so sick of people thinking the world owes them.
