I have not read every comment here so hope I am not repeating anything. I agree she needs to get the laws applicable for her property (if she owns it). It is the neighbors problem if THEY can't do business with Tyson (should of been something they worried about when selling). I don't doubt Tyson has these stipulations............watch a documentary called "Fresh"..........it's all about big agri and commercial chicken/cow/pig raising - the couple being interviewed also owned a tyson chicken "farm".....they flat out said that the company won't place chickens with them if they don't follow the company's rules. They even tell them what food to eat and litter to put down etc. If you saw the footage in the film, you'd be about as disgusted as I am. So I am not surprised by this. Since I have a christian, libertarian mindset, both of these folks have the right to do whatever they want on their own property. If the tyson farmers depended on that property being free of chickens, they prob should of considered not selling it because it isn't their business what someone else has on it.

I hope the OP looks into the laws and exercises her property rights. People everywhere need to start standing up for their liberties like the Bakers Green Acres folks are doing.

1. Be very polite but very firm - Tell the old owners and Tyson to go pound salt.
2. Add more chickens to your flock and put your pen as close as possible to the Tyson property.
3. If necessary call a lawyer and have them be your voice.
4. Make sure you call the local news paper and TV news station(s) and tell them your story. If there is any need for a face-to-face discussion with Tyson or the previous owner make sure the cameras are rolling.
5. Tell Tyson to move their operation away from YOU as you do not want YOUR flock contaminated.
6. If necessary, get your shotgun and run around the yard like you're crazy. Just kidding.

Seriously, do not allow anyone to tell you how you must live. Ever.

i find it hard to believe that a company could have that type of stipulation in their business contract.
Other chickens being near the tyson chicken farm is not something that can be controlled. I would guess that the old owners are worried about loosing some of their profit just because it might be a possibility of your chickens getting sick.
If the tyson company becomes that worried, i would guess that you would get some legal paperwork in the mail from them.
I'd keep my chickens till then
x2. Sounds like the people you bought your house from may be blowing smoke up your ***. I would for sure ignore them unless and until I got legally served with papers.

I would have to agree with this post, that is crazy, and unless they want a huge media circus they better get the heads outa there butts.
If you signed no agreement to not have chickens with your closing, then they can go to He!!........... its your property, oyur mortgage, your taxes, let them move there pens, for I am sure they have much more money than you do........... whats some garbage.......... arggggg :mad:]
 
I'm alot confused, what exactly are the old folks saying and why does it not ring true to me, there's something major left out - I don't think Tyson cares if you have chickens or not.
You previous owners are not telling you something that is way off from the, 'story they told you, I wonder what it is.
 
Please someone have a answer for me
I have 30 chickens I have raised from 1 day old, today the people I bought the house from told me I had to get rid of the chickens because Tyson will not allow them to have their business (raising Tyson chickens) so close to me and my backyard chickens. The old owners felt downright bad asking me to do this, it's the way they make their living. I understand that, really I do. I have 40 acres I could move them a 1/2 mile away from these other chickens, but I will not be able to enjoy them like I do now, they would not have water readily available to them, I would have to truck it to them, not to mention when it gets cold, I will not be able to give them any heat.
My question is this, does anyone know if Tyson can close these people down because I have my baby's so close to these barns? I am just sick!!!!!!
I'd tell Tyson ok but when taxs time rolls around you can pay the taxs man. They can't tell you what to do its your land.Chickens are livestock like cows. Just because they are a big company they can't tell you what you can & can't do.
 
I know some people who are poultry farmers and, yes, this is the kind of thing that goes into their contracts. They also have to verify that any employees don't have poultry at home. The usual reasoning is that you have to have X amount of space around your poultry barn, since you can't control what your neighbors may decide to do on their land.
It sounds like this was once not an issue for them, but now that they have sold the other lots they realize that they no longer have the required easement.

If they can make you an offer that is worth it to move or give up your chickens, then I would take it. But, for me, it would take a generous deal to make up for my inconvenience of traveling so far to care for my own birds!
 
why dont you get your birds npip tested . that should show your birds are not sick . dont see why you could not keep them if you get them tested and if you own the land how they could tell you what to raise on it . you might even have to get a lawer to answer your questions . good luck with this .
