I need facts so that I can prove my chickens are pets

I agree with Cetawin, HOAs are bad news. I work as a land use planner and deal with zoning issues on a daily basis. At least here in California issues between a HOA and a resident in "non-compliance" with HOA issues would be considered a civil issue between the two parties. Meaning the City would not get involved. It the City where I work there is at least one newer subdivision with conditions which would under strict interpretation prohibit chickens even though our zoning code allows a few hens to be kept as "domestic animals" in residential zones. If you live in a development with an HOA treat them with kid gloves and do all that you can to appease their concerns. If active and you get on their bad side they can make your life miserable.

While not proud to admit it...it was my job. Things with an HOA are delicate to put it in a word. I have spent hours talking to HOs and explaining to them repeatedly...I understand you have mortgage, I understand you pay your bills but I also am telling you, your garage door did not meet the requirements and specification of the Dec, the HOA had it replaced to meet the requirements, placed a lien on your house, the cost is 2300.00 plus my costs and fees now making it a total of 4,800.00. You have 30 days to pay or this firm will foreclose the lien, take possession of your home, have you and all your belongings removed and hand the house over to your mortgage company in exchange for the 4,800.00 judgment pay-off. PLEEEEEEEEEEASE make payment arrangements with me and work this out.

And I cannot count the number of people who absolutely ignored my warnings, told me to pee off to F off to whatever....45 days later I had a sheriff and a moving crew taking them out of their home and putting all of their belongings and property on the curb. The HOAs Decs are written to protect them and the community not the HO, they can assess fines for failure to comply and whole host of other things.

Do not...DO NOT play with the HOA. So, get me the info I requested and let's see if there is a way for you to keep your hens. I cannot physically help you but I can sure give the HOA hell through you if they left so much as a hair sized gap.
