Is there a problem if you have a rooster and hens together? We want to eat the eggs not have baby chicks?

As long as you pick up the eggs every day and don't let the hens sit on them, they will be just like regular eggs. They need to be kept at about 100 degrees for 24 hours in order to start developing into a chick.

The problem is not from the eggs being fertilized - that is simply addressed with regular (daily) collection of eggs. However, with only four birds and crowded conditions, the problem of keeping a rooster in your flock will be potential overmating, rooster damage to the hens, etc.
