My mom was reading the paper and found this article which i think is absolutley unfair! A family of five goes completely legal and builds a farm getting all the permits and being up to code. They spent 21,000 dollars on their project only to have the permits nixed and their farm taken away. They were planning to keep 2 horses 2 goats and several chickens please read the article hyperlinked below because i am in total disagreement with this and being a resident of sammamish i am going to complain.

Well, it wasn't "taken away" technically. They still have their land, but can't go ahead with all their plans. I hope they fight it.
 
The article doesn't say what portion of the HOA covenants the farm & animals would violate, and they received permission from the HOA Architectural Committee. Sounds like they need to fight for their plans.
 
Thats totally true and apparently the neighbors complained to the city council about the animals but the HOA was protesting for them cutting down 43 trees, and permits from the city go above HOA in chain of command. One thing to think about is that u need nearly nothing to own a dog they are bought and kept every day and in sooo many places! Chickens are only legal in some places illegal in others yet they r self sufficient give comfort and produce food! they are also quieter than dogs my neighbors parakeet is louder than my hens and it is only 4 inches tall!
 
I read all these posts on Laws and Ordinances from all over the USA and each one just reinforces the life we chose almost 20 years ago. Just to be happy in a place that needs commerce of any kind, is tolerant of others, and is not "uppity" since everyone needs everyones commerce. That was and is REAL Hope and Change.
What has to happen? does there need to be great depression 2.0 for people to realize that places like this are an ASSET to a community?

I have a good friend who lives there (in Sammamish) who would tell me that this is typical. retroactive reordinance since someone complained.

They should fight this since they have a vested interest, 21 grand...
 
I guess the question is whether the HOA documents allow them to control landscaping to that extent.

I think I can understand (due to a local commercial situation here about a year ago) if they were removing all trees/vegetation, but for goodness sake, they still have over 160 trees--a veritable forest!

HOA covenants cannot be more lenient than laws, but can be more strict. For example, if the law implements a setback at 30', the code cannot change that to 20', but can require 40'; if the law says no more than 5 hens and one rooster are allowed, the HOA can say no roosters, but they cannot say 20 hens and 3 roosters.

It just bothers me that no1 has a problem with dogs and they make a fuss about chickens when dogs are noisier and more destructive that chickens i can understand tho if they said just please no roosters
 
The whole reason DH and I are looking for our own place (when we can afford it) in the country and no restrictions on what we can do on our own land. (legally)

I just do not feel that when you own your own land that someone else can tell you what you can and can't do on it with in the Law.

Plus, they had to pay for those permits (at least here you do) so paid out that money too

HA - The article said that she acknowledged that "16 chickens might be more than normal." I've got 31 - guess that makes me an official CRAZY CHICKEN LADY!!!
