Ummm, its probably based on the fact that #1, even feral Muscovies don't migrate
and #2, most domestic Muscovy drakes are too big to fly.
But what does common sense have to do with anything when it comes to
the fed. government?
Next they say chickens are migratory birds.

So they are saying the Muscovy is a MBTA-protected species.
That means they consider it a migratory bird, but it's NOT!!
So it shouldn't fall under the MBTA jurisdiction.
So they can's regulate it's ownership under this act - maybe??
