I emailed Mr. Allen and this is his reply:

"Hi Steve:

Thank you for your suggestion. We published a proposed rule on the muscovy duck in 2008. We received few comments, though the proposal was open for comment for two months. Therefore, I wasn't aware of some of the issues related to muscovies. I'll be happy to consider suggestions for changes to the regulations, if you wish to provide them.

We need to come up with something(I just don't know what) that will satisfy both parties. I do believe will have to purchase permits to keep these birds(which I do not like).

Wouldn't it make sense to outlaw them in say Texas if that's where the problem is? Did anyone give you wild bird harvest numbers for last year? Do the numbers expand beyond the 3 Texas counties in question? It's like making people register their cat. The number of pharrell cats far exceed ducks. It just seems like yet another misguided attempt to make another useless law. They tried to pass a law that would of made all New Yorkers register & put tracking devices in their livestock. Could you just imagine how many of those devices would be sloshing around in the old foxes belly (would make it easy to track him down). We need more new laws, like we need more law makers.

I tweeted a link to here and a link to the petition. Hopes it helps some. There are Scovies almost every week at the auction and I know people who have over 100 Scovies and depend on the money they make raising them for their lively hood ( to sale the eggs and live birds) so to say there is no economic impact is just wrong.

ok so why isnt the APA doing this they have more pull and I would think more experience is wording a new regulation that will help everyone. Is any one talking to APA if not IL call.

The problem from my perspective is:
1. Pets or show birds are not allowed unless acquired prior to 3/31/10
2. Legally own pets or show birds cannot legally be bred after 3/31/10
3. The food production exemption is not clear on what constitutes food production. Based on the wording of the regulation and the accompanying explanation (see link in first post for a link to the regulation and explanation) it sounds like the exception is for businesses only - not for backyard flocks.

Sent my letter off to Dr. Allen today... for what it's worth. Sigh!! I really wonder how many of these letters he will actually read. Mine was a bit lengthly but I wanted to address a number of concerns with this regulation.

I am waiting on a reply from A judge pal who knows the APA President if nothing than il call . This whole thing is getting absurd................
