If muscovies were wild birds, it would make sense for FWS to regulate them. Since they ARE domestic, it does not. And I believe it becomes an issue that individual states where feral duck populations are a problem that should deal with in the same manner as some have regarding the sale of chicks and rabbits at or near Easter time. Areas where there are no problems will likely not expend the energy to create or enforce unnecessary regulations for a non-existant problem, and areas that DO have a problem would no doubt be first in line to create state regulations. I can see FWS creating a federal ruling that muscovies cannot be released into the wild, but I cannot see that they should have the authority to outlaw them being kept for whatever reason an individual wishes (sans releasing them into the wild).
