The mallard is protected by the Migratory Bird Treaty Act making it unlawful to pursue, hunt, take, capture, kill, possess, sell, barter, purchase, ship, export, or import or own any mallard, or any part, nest, or egg of a mallard. This carries a fine up to $15,000 and possible jail time up to 6 months. The only exception is captive-reared mallards as stated in the Permit exceptions for captive-reared mallards as applicable by US law. The US FWS does allow people who find injured, sick, orphaned ducks to take possession in order to transport the bird to a permitted wildlife rehabilitator.
