go to Paypal and file a dispute, Paypal will then freeze his paypal account until you recieve the item or your refund.

chick, if worse comes to worse...I order out of print books from Barnes & Noble on line and they even found me one that was very, very old in very good condition ...since they also sell dvd's maybe they can find the original track for you?
Wouldn't hurt to check it out?

File with eBay and PayPal ASAP. It may take a while, but you'll eventually get your money back. I've had this happen only once (out of the hundreds of transactions I've made) and it took three months to get $30 back.
There are several things to look for... not just the % of feedback. People are very sneeky and will sell items (usually recipes or e-books) for 1 cent just to get positive feedback. Then, when they actually DO sell something of value, they'll swindle the buyer.
The best thing you can do is support the sellers that have e-stores. They have to maintain a certain level of positive feedback and sell a certain $ amount a month. I do this for work... I sell all of our clearance stuff, and I'm still learning, but I'm also becoming very eBay savvy.
