It is th owners fault.When Baily the lab goes across the street to the neighbors,when she gets back she gets a good beaten then is put on the run all day and in the basment all night.She dosnt leave the yard much anymore.If I were you I would exspect compensation for anything lose,broken or killed.If they cant do this and think it is not worth it then you need to do what you can to make your chx safe from this dog.....i.e......223?nah.....5.56!lol

Why the heck can't the dog be tied up??!!
Most towns/cities have a leash law...and it's for the dog's protection also. I'd make darn sure that the dog couldn't get back in the chicken yard even if it means SSS or a trip to the ACO. And I'd hand the neighbours a bill for all of the aggravation too...

Leash laws are made for when you walk your dog. Its not to use as a babysitter. Chained dogs are much more likely to attack. Not to mention being chained all day long is just plain cruel.

First I would call Animal Control and have them come out and look at your birds and explain what your legal rights are in this situation. See what they will do. If it happens again, when the dog is there, call it to you, offer it food, whatever, then catch it and tie it up or put it in a crate. I would call Animal Control to come out and complain to them explaining the problem. They should take it away then call the owners to come get it. This will begin a paper trail to prepare for the next time it shows up, hurts/kills birds, and gives you the right to protect your livestock. It also lets your neighbors know that you are serious about keeping their dog from killing your birds and puts the responsibility in their hands for their pet. imho

Bubba, I agree that chaining a dog long term is cruel. It's entire yard should be fenced is such a way as to keep the dog from getting loose. But it is the owners responsibility to contain and control their pet. If they cannot, they should rehome the dog.

In my town, leash laws also mean that YOUR dog needs to be kept in YOUR yard. Behind a fence, in a kennel, whatever it takes. Not roaming and killing people's birds.
I've talked to my ACO and he said to shoot him.

First, I want to thank everyone for the fellow-feeling and good ideas. It is such a relief to have somewhere to vent without anyone saying, “Geez, get a grip! They’re just chickens!”

Second, I’m still not sure what to say to my neighbors. We are not great pals, but the relationship is friendly enough (I‘m actually fonder of the dog than of her people). My plan is to go to them assuming they don’t know exactly what the dog has been up to. I’m going to ask them what they do as a deterrent and request permission to do the same. Of course, these chickens are a part of our livelihood and I intend to defend them as such (quite apart from the fact that I am very fond of them!).

Just a suggestion, when you go see your neighbor, take one of your badly wounded birds with you as proof. This way they cannot think/say you are exaggerating the situation cuz their dog would "never".........

Final post: I talked to the neighbors tonight and they were very receptive. They knew the dog had gotten into the pen, but were unaware that she had injured the chickens. They offered to reimburse us for damages; thank God, I was able to assure them that I had been able to treat the wounded chickens and all were healing very nicely.

It turns out they’ve been looking for an excuse to rehome the dog; she is very territorial and keeps marking the rugs throughout the house. That was actually very helpful to our discussion.

Do you know that chickens are considered livestock and that if an animal, any animal is threatening or endangering them in any way you have every right to shoot that dog, cat, etc. IF you choose this course, you will be required to call animal control; they and you will take the dog to the owner’s home and explain why you killed their dog. Then that’s it. They have a dead dog and you are cleared of all charges... been there done that!!!!!!! I know it is harsh, but what’s more important??? Your chickens dead or alive???

By the way, most states follow this law, BUT, you might want to check with your local animal control or police officer.
