Neighbor killed one of my birds

I got almost 40 here and most of them roost up in a tree right by the house, I don't even hear them unless I turn off my fan, guess the insulation does a good job of keeping out the noise.
 
Hawaii plantation style house 1/2" or 3/4" tounge and groove boards for all walls no insulation you hear everything windows single pain with counterweight on a rope.
 
It was actually unlawful for him to shoot your bird, even if it scratches his car or his girlfriends car. You should make him pay for the bird he killed, but only after you file a police report. There is no such thing as a noise complaint in the country side. That only exists in the cities. So get the police report so there is a record of the incident, make him pay, and if his dog every kills your chickens again, shoot his dog. In most states you have a right to kill a dog that is harassing or killing your livestock. Or you can call the police and take him to court for the dogs actions.
 
not true. fish and game has no regulation whatsoever over domestic animals. Native wildlife may be taken with proper licensing by law,( except where said wildlife is causing direct harm to you, your property or livestock, and generally you need to contact the officer and notify them) but there is no such permit for taking livestock. thats like saying i couldnt butcher a hog or meat chickens or whatever. that said, should the neighbor have shot the bird? no. Was he within his right to do so? from a legal standpoint, yes. It sucks, but you cant prove that the neighbor knew it was your bird, and not bieng a species regulated by a government agency, theres really nothing you can do other than come to an agreement with him.

um actually, he's within no legal right to shoot and kill another persons livestock if it enters his property. the animal is NOT his property. And you have to be careful about the definition of livestock in many states. Some states only recognize "livestock" to be a very strict amount of animals. I know that in my state, that is limited to "Cows, Pigs, Horses, Buffalo, Poultry, Rattites" and then under poultry the definition from the state is "Chickens, Guineas, Ducks, Geese" but it excludes the pheasant family, and classifies them under "Gamebirds". And gamebirds cannot be hunted without a license/permit, and that all domestic gamebirds must be registered with the states Dept. Agriculture.

So if this had happened in my state, shooting a peacock (since it's a pheasant) would be illegal under fish and game regs, unless you are the owner of the animal.
 
You might check with law enforcement on this one. I know you are allowed to shoot to defend your animals, property, etc but how threatened could he have been by a peacock?

Property is a pretty loose word. You can most certainly shoot a dog that is attacking livestock or pets, but in some states the rule is "You can only shoot the dog if it's acting on it's own"...which means, if the guy is standing on the property line and commands his dog to kill your chicken, you have no legal right to shoot the dog. Some laws are just stupid and weird.
 
i guess for the most part i lucked up with a good neighborhood no one shooting someone elses birds everyone wants my birds in their yard to take care of ticks and one neighbor has chickens also and his go to other peoples yards even mine, our chickens spend the day together and my ducks and geese mingle with his ducks they come to my ponds and his ponds but everyone goes to their proper places at night. all in all the birds have to be pretty happy they have our 270 acres and his 60 and then the neighbors yards all three of them to free range in oh and not to mention that the waterfowl have their choice of seven ponds to swim in. but i do have one sneaky old neighbor who tries to sell my birds behind my back (yes i know it's part of the reason i free range) the most recent is when he tried to sell my peafowl (he would have to catch them first). but hey every flock has one black lamb right?

makes sense to me, you shoot the owner then, not the dog who's just obeying orders.

That's crazy, what does he do take orders then fill them with neighboring birds.. mabe someone should give him some chicks to raise, I mean if it turns out he likes them mabe he would understand how it would feel of someone took them.
