If you have an official dissolution by the HOA and copy on record that has not changed or been revoked you may be in clear but you still must make sure you are not violating any rules of your local planning commission. Local laws and ordinances still rule here. Make sure you are in accordance with both. I would send the gentleman a copy to let them know you are in compliance with both and half a dozen eggs signed your family with love and peace. It will not matter if Roos are banned in your area and others have them. If someone complains you will have to get rid of the animal. Good Luck!

Someone here went through this in HOA
Community over the American Flag Pole being on his front lawn and he was a veteran. The problem was he got verbal permission for it and it has in HOA laws and rules that it can not be placed on the property. Order was to remove the flag pole 7-9 years after it was placed because someone noticed it. Make sure you are abiding by all current laws and rules with both local ordinances in your city or town and any HOA ones as well. Good Luck! Be as friendly as you can be. My husband and I make homemade gifts for our new neighbors as a welcome to the neighborhood. It goes a long way.
 
Still consult a local law firm. If you can I would find the law office responsible for the original HOA. Confirm the dissolution status and get it documented, preferably notarized. Also get copies of any state, county, town, and local laws regarding anything titled Pets, livestock, poultry, nuisance animals, zoning, and noise ordinance. Check all these laws and see if you are in compliance. As long as you are, there's nothing he can do. If there are compliance issues, see what you need to do to get right. I've had a neighbor similar to this. If this person is the same, even if you win on the rooster he will continue trying to find other things. Sometimes people really don't have anything better to do with their time other than be a nuisance to others. If it's starting well before he moves in, the rooster will not be his only complaint. Sorry, I feel you may have a long road ahead.

According to this thread, there was a rule that outlawed flagpoles. That's not preventing disputes; that's making for a ridiculous level of tension and persnickety, tattletale neighbours with nothing better to do with their time than stalk about with a pair of binoculars, à la Petunia Dursley.
 
Side note--why in tarnation would anyone live in or make an HOA? Living in one sounds like living in suburbia hell.

No HOA rant thread just help advise the poor fella. Forgive me but I have a dog and I have stayed in areas with Roos and was woken every morning by a roo or angry cats at 0400 every day. Coffee isn’t even brewed till 5 am. I am not partial to Roos but I don’t live near them either. Just common sense. I hope it works out peacefully for both sides. I also hope my dog doesn’t wake anyone in the am but she at least lets us sleep till 6-7am. God love her. Dogs not outlawed here just Roos. That said Roos get all the pretty feathers.
 
Sounds like a legal issue so best to talk to that lawyer.
Forums are great for sympathy and support but not so much for legal advice.
If you do want advice just tell him The Moonshiner from down Missouri way said there isn't a d@mn thing he can say about your rooster and from now on every time he brings it up you will be adding another one. :D
