I would love to see one example of that. Any links to such a cases outcome involving reduced compensation for owners lack of providing adequate protection?

That responsibility is on you. I indicated what I would do if holding court on this case based on information provided. It is easy to see judges can vary greatly based on passed judgments resulting in their having reputations going one way or another as a general pattern.


Like you you have indicated about yourself, I have kept chickens for a while. I protect my birds, even free-range. If dogs defeat my efforts, then in all likelihood damage done to more than just birds. Then additional cost would come with those damages.

No, there was one party at fault the trespassing dogs owners. PERIOD. Just because YOU think the chicken owners should fence out the dogs does not make it so.

I know around here most use barb wire to fence in their cattle which in no way would keep a dog out. Others use field fence as do most goat and sheep owners. Field fence is better but in no way going to stop a determined dog.
It sounds pretty ridiculous to think a court would lower compensation because someone used a fence system that wouldn't keep a neighbors dog out.
Sounds like victim blaming that the dog owner would try to pull not anything a judge would consider in his ruling.

In mt parts, more than fencing is used to protect sheep and goats when dogs and/or wildlife are an issue. Cattle are generally safer. Sometimes you can sue dog owners but not not mother nature. Defenses you try to make proportional to threats at hand.

Thats not the point, you said there were two parties at fault. The dogs owners are the ones legally on the hook. Yes we have a responsibility to protect our animals, but when push comes to shove the dogs owners are responsible for the losses.

Maybe we need a few parties to report judgments concerning situations like this. That would give some insight into what to expect. I do not know of anyone personally that has been in court over such. I do know a lot people that have chickens lost to dogs.

My point appears to have been made. Lets see what it offered so those loosing birds can optimize their approach.

I've been to court once over lost poultry when we had no fencing and was free ranging.
Actually it ended up in court because sheriffs were involved because of dog owner due to me shooting their dog and returning it to their front porch.
Lack of protection on my part was never an issue or brought up. Dog owner believed I used deadly force when it wasn't necessary.
I believed it was necessary because of volume of birds killed and it would not stop its rampage.
I supplied CL adds for compairable birds. Case lasted about 20 minutes and I was compensated asked amount and dog owner scolded in open court.
