The open well was there prior to the new owner's purchase, wasn't it?

I might not be okay with a saw mill next door to me, or a gas station or food mart or feedlot. But one thing I know for certain --- I don't own the scenery, and I would be very upset if my nieghbors tried to restrict what I do on my property.

If the survey was in error, you have a legal recourse, hire your own surveyor. Then do what you have to do to get your property back with compensation for destroyed shed.

Using YOUR driveway. Also once again if it is indeed your driveway, no way no how can they tresspass unless you allow them to.

I suspect that the driveway is a deeded right of way or maybe an easement.

I've noticed that folks here are strongly in favor of doing whatever they want on their property and against the neighbors doing what they want on theirs.

You NEED to pay for your own survey... thats about the only leg you have to stand on....(and of course use a different company then they used..

)
I would check the laws about the well though... you may be able to get them on that.... but they'll just cap it and nothing will be done.
About the saw mill,... are there noise restrictions in your area?? You need to contact the Zoning board..

But really, as long as they arent going onto your property... they can do what they want on their land.

I don't own the land they do. I am not allowed to tell them what they can and can't get. The well only poses a threat if people tress pass on to their yards and decide to jump in. Your children won't get harmed by it if you tell them they can be dangerous. I don't remember people always having to cover wells. Until modern day. Kids in villages tat don't cover wells don't have a lack of children.

I thought in logging there are things like property line and road setbacks, not to mention definitely federal rules for any stream/river/seasonal stream setbacks...State of Georgia at least is tough in some of these. Erosion control and wetland protection too.

I'm sorry you are having to put up with such inconsiderate behavior. I'm sure you can file a complaint about the amount of noise they will be making, if nothing else. Go to your local town hall and find someone sympathetic to talk to. It really stinks having bad neighbors.

We recently lost a four foot wide strip at the back of the house we own. When we moved in 3 or 4 years ago, we replaced the existing fence but didn't move the fence line at all. This past summer, the new owner of the property behing us came to tell us we had to move the fence because it was on his property. We did some investigating and found that he was correct and the fence was moved. We weren't happy about it, but it was his property.

I would do as others have suggested and have a survey done by a different company and check out the zoning laws for that parcel. Is there something in your title that makes your driveway an easement for the other property? If not, don't give them permission to use it.

I think what you really need to do is research how land can be used where you live, get a surveyor to check the pin, and if it is your property, get the pin moved back and sue for the loss of the structure. Also, if the well is "illegal" you can find out what that means and/or report it if you wish.
