Holly, approach the variance process with extreme caution. Do you know if this is an administrative approval or has to get formal approval before the zoning board? If the zoning board must approve it, ask to see a copy of a variance staff report. What I am interested in is if staff has to make specific findings regarding the variance. I ask because here in CA, a variance is by far the hardest for staff to recommend for approval due to the specific findings they have to make. What I mean by findings are various statements (all which must be answered in the affirimative) regarding the project. For example, in CA one of the findings states that there has to be something unusual about your property which is different from your neighbors (shape, size etc) which basiccally denies you the right to use your property like everyone else. Otherwise it would be considered a "grant of special privledge" and not allowed. Arguing that their project is worthwile and not speaking to the findings is one place where applicants for a variance here in CA often go wrong (I speak from experience, having had to take variances before the Planning Commission as a staff person and requesting denial due to these reasons). If your township does not have similar requirements I will breathe a BIG sigh of relief on your behalf.

I think it's a very informal meeting. We have talked with Ron McMullen, He is one of the board members, and he already indicated he has no issues with chickens.

Until they can give me a legitimate reason to not own Chickens, I will not give up.

after the hearing, Officer Leskin (I couldn't believe he said this) asked "what will it take for you to get rid of your chickens?"

At that moment I wanted to say a nuclear holocaust!

But was flabbergasted and said nothing. I'm not even sure my Husband responded to it.

And this whole thing is happening because My neighbors (2 of them) are complaining. But anyone else I talk to in town hasn't said a thing. They are more apt to encourage me than anything else.

I have to wonder if there is some sort of relationship between the old lady and the officer or else it wouldn't be so darn important to him.

Good on ya for not letting these idiots wear you down. If the law spent more time catching crackheads like the ones that keep moving in next door to us, and less time harassing people about their chickens (I mean, REALLY??) then life would be better all round.
