We Have. They do not seem to comprehend that their is no Ordinance stating it. We have a copy of it. The judge threw the citation out as their is nothing in the ordinance to be able to cite me for.

Seems like the town is trying to see if they can get some money from you. I would hold off on the variance until after you talk to the State Attorney General.

These people have no clue. Why would you spend money on a variance when there is no law or regulation to vary?

I believe your lawyer needs to send them a letter asking several very specific questions:

"exactly which paragraph and sentences in the ordinances of city name are you directing the Holly O family to address in seeking a variance?"

"what is your basis for requiring $500 in advertising, your lawyers, my fees and another $250 for the hearing? Please show me where these are usual and customary costs as already set forth in your ordinances and administrative procedures."

"what is your basis for contradicting a court ruling and limiting the birds that may be kept before a variance hearing is held?"


At this point I think you should file suit against the city as a whole, the individual officials who are involved and the complaining neighbors.

I agree. This has gone on long enough and the city does not have anything solid.....They have to be pushed into either proving they have an ordinance or rule that was violated or get of your back and maybe come up with an ordinance
