You are totally not being unfair. This dog has got to be retained somehow. Is there a leash law where you are? She is responsible to keep this dog off your property. My black lab takes care of any "strays" that wonder onto our 10 acres. I'm so sorry that your time, energy, money, patience has all been tested by this dog. I love dogs, dogs that don't kill my livestock. You probably need to ask her to rehome the dog, if the dog gets on your property again you have to defend your livestock the hard way. I have to give this woman credit for being a "good" neighbor and paying you your losses. This is a tough one.

she should invest in a tie out. I cemented my tie out in the ground and its got a really thick leash.

or she can get a dog crate. Does she have anyone to supervise these dogs?

CHAPTER 28

DOGS

25-2806. LIABILITY FOR LIVESTOCK AND POULTRY KILLED BY DOGS. The owner, possessor, or harborer of any dog or animal that kills, worries, or wounds any livestock and poultry which are raised and kept in captivity for domestic or commercial purposes, is liable to the owner of the same for the damages and costs of suit, to be recovered before any court of competent jurisdiction:

1. In the prosecution of actions under the provisions of this section it is not necessary for the plaintiff to show that the owner, possessor, or harborer of such dog or other animal had knowledge of the fact that such dog or other animal would kill or wound livestock or poultry which are raised and kept in captivity for domestic or commercial purposes.

2. Any person, on finding any dog, not on the premises of its owner or possessor, worrying, wounding, or killing any livestock or poultry which are raised and kept in captivity for domestic or commercial purposes, may, at the time of so finding said dog, kill the same, and the owners thereof can sustain no action for damages against any person so killing such dog.

I am sure that it varies state to state but everyone should be informed of what their state and local laws are.
 
Of course the humorous side of the situation is that I would shoot the dog, grab the shovel and realize that I can't dig in frozen ground =]

Hey I had a big chocolate Lab that was very expensive and an excellent hunter. Well, one morning I found dead chikens at my back door. They were my neighbors. He got loose and went on a killing spree. I knew after the first time, it would never stop. Sure enough, it happened again! Needless to say, I sold the dog. Thank goodness, my neighbor is my wife's uncle. All his chickens are free range. So they really didn't stand a chance. Now, I have a lot of chickens and I don't miss the dog. I would never keep a dog that kills chickens, no matter who they are for. It's kinda of like your duty as a dog owner to fix the problem. It sounds like that your neighbor isn't trying to fix the problem.
 
*where I live, euen my single chicken is illegal. There's a 'neighborhood clean-up' scheduled for the wkend WITH police AND code enforcement agents-- I'll have to keep Chook buttoned up for the duration! Sucks. OH! & probly my son's cat, TOO! Not 'fixed' yet. . . (sigh)
