Olive Egger? Rooster?

Hi! I got this bird from mypetchicken. It is supposed to be an olive egger pullet. I know 4 weeks old is generally too young to tell a hen from a rooster, but this bird is looking awfully suspect. Any input is much appreciated!

Here's why I suspect a rooster...

Bright red comb developing
Aggressive behavior (picking fights with the other birds)
Upright tail
Upright posture

Please tell me I'm wrong! We can't have roosters where we are...or even chickens at all for that matter (we've been fighting to get chickens allowed for 2 years and they are still denying it)...so we are really hoping this bird is a hen like it is supposed to be.

We have a privacy fence. ;) it's basically a report only policy. So if no one reports us we are fine...but a rooster will certainly get us into trouble.
I have been fighting our village board for 2 years. They refuse to listen to reason. We even have 110 signatures (including all of our neighbors) who are totally ok with chickens. All surrounding areas allow chickens. The board is being very rude about it. They reused to let us speak at the last meeting and had the police chief escort us out in front of my kids (we weren't even doing anything). I asked if I could speak after they voted the ordinance change down again and the president said no and to vote him out of office if we didn't like it. I've provided so much information and spent hours upon hours researching and trying to change their minds. They won't budge. They keep saying things like "we just don't want them", "they smell", "they'll attract hundreds of coyotes." I've refuted all of these false claims. We are now taking it to a referendum vote. It's so sad, but I won't stop fighting! We even had shirts made and have been handing out fliers.
