Wow...that is close. It does look to be 5 feet from the fence, though, but not by much, so it would appear that legally you are fine. The problem as I see it might not be the proximity to the fence as much as proximity to the neighbor's windows, etc. I have to be honest and say that If I was a non-chicken owner I'm not sure I'd want that short a distance between my windows and my neighbor's chicken coop. If my chickens are any indication the noise factor will certainly become an issue again as they age. They can be loud, especially early in the morning, and although mine haven't started laying yet I understand there's a joyful, usually loud, "song" sung by the hens after laying an egg. You might be well within your setback requirement but I can actually understand why your neighbor might have some concerns. How many chickens do you have? This one might not be as much a question of legality but rather one of courtesy. I'm sure that's not what you want to hear and I'm sorry about that, but that's how I see it.

I agree, the side of the neighbors house that is closest to the coop is the garage/laundry room. We almost purchased the house about 10 years ago, so we have been in the house. I understand what you are saying, and I agree that it could potentially be an issue, but the bedroom is on the other side of the house. If it does cause a problem, I will move the coop, but since it is brand new, I am going to keep it where it is, and offer as much noise reduction as I can. No matter what, there are chickens in the yard that is kitty corner to his backyard, so there will be clucks and chats going on in the morning. The other issue is that this particular neighbor chooses to chop wood in his garage at 2 AM in the morning on a regular basis. We could actually hear the noise and it honestly took a while to identify (after waking up) but never said a word....idk, I love my chooks and will be flexible, to a point...

Im also curious about how the noise will affect our neighbors. We live in a suburb of Beaverton and ironically all of our neighbors have larger yards than we do. This does mean that everyone's houses is on the other side of their yards, so house wise I think we are fine. There is one neighbor who has a shed that is very close to our fence but I never see anyone go in there. Would that be an issue? Our coop is a little starter coop and since its so light its easily moved, but for now its closer to our house so Im hoping that will also be acceptable.

Here is a pic of the space between the fence and the coop/run. The problem I think it's the nose when I was building. The coop is now finished, so the nose from that should be over

What's the measurement you get from the base of that fence to the base of your coop/run?

Ooops! Well, as "technical" as government officials can be, I'm afraid they're gonna win this one. I know it would be a huge job, but can you move your set up over that last 5 inches?

Im hopeful that nothing comes out of it. Someone would have to hire a surveyor from the city to measure exactly where the property line is, and I don't think that anyone will do that. If it comes down to it, we will move it, but then there would be more noise. So is up to the neighbor at this point. Iguess I would have rather had someone talk to me before the city was called. Living in the city we all have to share space. We have another neighbor who regularly shoots off illegal fireworks, and we have asked as nicely as possible not to, and still it continues. So some how we all just gotta get along.......someday a place in the country

Aaah, yes....a place in the country! And you're right, it would have been nice if the neighbor had some to you first. Maybe you could give her a few fresh eggs now and then...to maybe smooth things over? Just thinkin' ... always a bad thing for me at my age!
