Another thing that stands out for me is I think that is an invasion of privacy, the fact that the neighbor's son took a picture of you in your own yard without your consent. I would find out what the law says about that. A tall enough fence to block their view is what you need at this point.

That is what I was thinking but I wasn't quite sure. If this issue gets worse I will look into that. Thanks.

Could the problem be that it is against the HOA? I know some cities allow backyard chickens, but the HOA's do not.

We do not have a HOA, but these neighbors do. Their backyard backs up to ours so they are in a different block.

There are a few people I have come across on this forum that are from Olathe that have chickens - not sure if they live in a neighborhood or not.

There is another thread here that talks about the laws being revisitted again this Monday for Overland Park. You might want to keep up to date with what they do.

I know in Lees Summit, I can have them because I live on agricultural land. They are researching allowing it in the city limits and neighborhoods. One councilman has said it is a step backwards. There has also been talk that there are so many HOA's that is might be useless allowing the chickens because they would not allow them.

I would keep an eye on both those cities since they are so close to you and see how the laws may change to maybe help change the laws in Olathe. In Lees Summit, they were tracking how many people called asking about chickens.

I just wanted to point out that, although it's incredibly rude, it's not against the law for them to take photographs of you in your yard.

If you can see it you can photograph it is what it basically boils down to. There are some specifics in there (like restrooms and changing rooms) but unfortunately yards are not among them.

I saw a guy once sitting on the sidewalk with his tripod, taking photographs through the open windows of a house across the street.

Morally disgusting? Yes. Illegal? No.



Look up your city code. If keeping chickens is allowed, if I were in that scenario, I would get more chickens and build a nice big coop and let them run around outside all day long. I'd give them something to take photos of.

Just start taking pictures of them and come up with crazy excuses as to why your doing it.When or if they ask what your doing just give them a warning look yourself turn around and go back in the house, leave them wondering.

That is not necessarily accurate. And the scenario you cited is definitely on the invasion of privacy. Celebreties' privacy is not as protected as is the general public simply die to the nature of the work they have chosen, but even they have the right to expect privacy in their own yard and home. Taking photos once of a location that just about anyone could have seen probably would not be considered an invasion of privacy, but if they were to aim a game cam onto your property or go to excessive lengths to view areas that are difficult to observe from off the property, they have probably gone too far.

It honestly depends on how visible their yard is. If they had to get a ladder or go through some ridiculous means to see over a privacy fence to take photos, then that is considered an invasion of privacy. If their yard is absolutely visable then it is not illegal to photograph.

You can ask them to stop and if they persist, they can be charged with trespassing, but their photos would still be theirs and legal.

If you are not allowed to have roosters and they are bothering your neighbors, it is within their rights to report it. Photographic evidence goes a long way, and people are often suggest that you photograph, journal, or record incidents taking place that they feel are objectionable to their right to ejoy their own property.

A lot of people are bothered by the slightest things and I KNOW it seems ridiculous. And it probably is.

But rather than breaking ordinances (if you are), its better and easier in the long run to fight to change them, or to only keep pets which you are allowed to have. Get ahold of the city and find out exactly what the codes are and where you will stand if it comes to a legal battle.
