I don't see the connection you're trying to make. The guy did something illegal in a foreign country. It happened to be bringing in a weapon, but it could have been anything.
Hopefully then they will reduce the charge to fit the crime.
 
It may be that they assumed that he had already verified that the gun was legal, and that he had obtained the necessary permits.

Any forms you fill out at the US side are for the US, not for Mexico. He was allowed to leave the US with his weapon after filling out the necessary paperwork. The paperwork informed the Mexican side of the crossing that he had not smuggled the gun out of the US. AFAIK he has not been charged with smuggling.

How the Mexican police choose to deal with people committing illegal acts is up to them.

This is just another example of the double standard in government. That guy ended up in jail, but the US Justice Department and the Mexican aduana can turn a blind eye to whole arsenals crossing the border. Somebody got something for looking the other way. The cartels got to someone in the Justice Department.

Pena Nieto says he is going to handle the situation in a different manner. He probably will just revert to the business as usual policy that prevailed before PAN came to power. Expect to see more drugs and violence on this side of the border.

This is a case of the Mexican officials seeing an American with a motor home and a load of camping gear that they wanted So when they saw the paper that said gun then they took everything. I would bet that all his stuff has been sold and the border cops got the money.

If you've ever been in a third world country, then you'd know just how corrupt that officials can be. I watched a cop in Guayaquil Ecuador at an on ramp to a highway stopping every car. He'd find something wrong and they'd hand him a handful of coins with assurances that they'll take care of it. It is a common practice to take home an extra $20.00 or so a day.
