Pulled over again!!

Thats illegal in the US. They need to have RAS to make a stop. Not just fishing...

He hasn't been pulled over, it's been while he was already stopped that they came looking. And like I said, he finds it slightly funny, "Me? A suspicious character?" He has offered to open the back of the truck a couple of times (he's kinda proud of his "garden shed on wheels"), but I think his casual attitude is more than enough to allay any suspicions.

But, they do have reason...a suspicious looking vehicle in a prosperous neighborhood. That would be all they would need to say

Reasonable Articulatable Suspiticion that a crime is more likely than not to be being committed.

That does not pass as that.

I'm just saying that with the judges around here, that would be enough. Most people just let it go since they know that it is worthless to fight...my xhusband was once stopped because the license plate holder, dealer provided, was 'illegal'...when, in fact, they just wanted a reason to stop the little fast two door car. Unfortunately, whether legal or not, it happens all the time.

They do get away with that kind of junk allot at the local level. Once someone pushes it to the state level stuff like that makes people wealthy at the expense of the taxpayers.

Not worth all that though unless an arrest had been made. For the small stuff its better to just file a complaint an file a records request on the stop. That is pretty good at stopping that kind of activity.

Sometimes worth pushing it though.

Rebel, it's really not that simple. Probably cause to pull someone over is REALLY easy to get. Everyone touches the white line now and again when driving - here in AR 3 times is enough PC (probable cause) to pull you over. Driving a little above the speed limit or a little below? Again it can be PC. Older car in a nice neighborhood? If there have been ANY reports of theft or suspicious people in that area over the last few days, that is PC enough to stop and just ask questions. Then your behavior/attitude is how they judge whether or not to run your license.

Believe me, if you watch a car for 5 minutes an officer can find multiple reasons to pull you over.

Speeding or hitting the line is not probable cause its seeing an actual law being broken. Older car in a nice neighborhood that has had crime reports is not RAS to stop anyone. They have every right to watch you till you give them probable cause but until they do it is a crime to stop them to ask questions.(Better not say thats what you did though) Even when they find reason to stop you they can only hold you long enough to take care of that reason unless they find RAS that a further crime has been committed. The supreme court has been pretty clear in this.

no it isn't. I know MANY police officers. If all they want is to say "what are you doing" they don't need anything more suspicious than you not fitting into the neighborhood. Or to see that you "look distracted" IE talking on your cellphone (even if it is legal to be on the phone in the car).

And no, touching the white line ISN'T against the law - I'm not talking about crossing over the line and going off the road. Just your tires touching the edge of the white line is enough. Believe me, it usually takes much less than 5 minutes to find a reason to pull someone over. Have your radio loud. Looking "distracted". Slowing down and speeding up (like you would do if you were lost or looking for an address). Not using your turn signal. Having a dirty license plate. Cluttered rear window (could be dirt or stuff piled in your car). All of these are reasons to pull someone over just to say "hey. I was just wondering what is going on." Any other questions need further cause but that isn't difficult either since a lot of people who are doing something wrong immediately get defensive or cop some type of attitude. Or else there is immediate physical evidence - smell of alcohol, smell of drugs, slurred words, jittery behavior, empty bottles/cans/paraphernalia visible in the car, etc

And a complaint of robberies in a neighborhood is probable cause to pull over any vehicle doesn't fit in. Also someone calling in that they saw a suspicious person.
