Question , kind of legal regarding check payment

I've done it before and the person got cash at the walmart i sent it too... no check or MO to deposit at the bank.
 
This is strange. If it were me, I would either stop payment on the check (or have them return it) give them cash, and make them give you a receipt. Take a witness with you when you do that in case they refuse to give you a receipt. Then, get as far away from them as possible. If they refuse to give you back the check, you can sue for any bank fees resulting in stopping payment or it (which may be less than court costs).

It's very hard to sue for harassment. For one, you have to prove damages directly resulting from the harassment. Examples are such as calling you at work all the time and you getting fired or in trouble for it. Or, causing damage to your property, making credible threats of bodily harm, etc.
 
I do not know if it has been said but cash money is "legal tender" for all debts in the United States any other payment is subject to right of refusal especially with written or displayed notice. Or it used to be that way.
 
Bottom line is, I will not, especially 8 weeks after the fact, send them a MO while they still have my check. Why should I pay to put a stop payment on a check, then pay for a MO and be out that money when they were perfectly ok with accepting the check in the first place? I don't have a ton of excess cash to just throw around and spend without necessity. I have thrown the ball back in their court and they have choices on how to handle this. At this point, because now I am angry, they began texting me last night and used $12.00 of money on my phone. I have to call verizon today to see if I can get a print out of the texts. They can either deposit/cash the check or kiss my behind!

That makes you just as culpable as they are, plus then you incur fees with your bank.

I sent them a certified letter yesterday, it stated they could either deposit the check or cash it, and that the harrassment must stop. I addressed it to the husband, just in case the wife (one doing the calls/texts is doing something behind his back. If I continue to get calls/texts I will file a report with the police. I never planned to stop payment the check, I am not going to pay out of my pocket to do that and they accepted the check as payment.
 
There's some financial mess on their end, either someone is stealing money from the other one or their account has been seized by the IRS or something like that. The thing is, if they had explained that they were in a mess and needed cash up front, she'd have probably gladly paid them in cash, gotten her receipt and gone on with life. They are lying that their bank refuses to take checks because a few checks from OTHER people bounced, they get extra fees for that, it's extra money for them.

Something is going on ON THEIR END and since they are being jerks about it, I say it's their problem to figure out. They accepted your check as payment, the check is good, they can simply go cash it and get their cash if they don't want to deposit it and pay whatever debt they most likely owe that has their account tied up.

I really hope you don't have to deal with them in the future for anything.

that isn't a Money Order. that is a money gram. . Wal-mart doesn't cash money orders.
