I think that you mean if someone comes into your house and is continuing to enter/persist in thier course of action. Not someone who merely chooses not to leave your home, there is a difference. And even in the state of california, if the person was in your house and was attempting to harm you, or was showing intent (other than lingering in your house) you could shoot them. You just can't shoot someone who is not harming or showing intent to harm.
