Road is being proposed through family farm!!!

If its your land and the COMPANY proposed the idea then you put down a statement with a number, with alot of zeros behind it for the land. They cant take your land under Imminent Domain just because of a company. It has to be public use.

It's eminent domain and oh yes they can use it like that. People on the coast here lost their houses so that the land could be given to a developer who built luxury condos on it - the use was considered "in the public good" by bringing in more tax revenue.

I VEHEMENTLY disagree with this, but it has been done repeatedly. There was a farm near here that was taken for the development of a golf course!


Use the press, use the press use the press. People are pretty sick of the little guy getting screwed right now, call the person who wrote the article and tell them no one had told you and you want the public to hear the other side.

Fight fight fight and at the very least hold out for the $$$​

I have seen it happen over and over and over.
Residents fighting did NOTHING. They still took the land.

It's only a matter of time before the town I grew up in takes the land my moms house is on and puts an access road through that as well.
As far as getting money for it goes. Ah ha. expect nothing near what it is really worth. It will be pennies, if you get anything.

The college up the street from me has been buying homes for nothing. More people have been displaced from the area where they used to be able to have affordable rent. And the college gives NOTHING back to the city. They dont pay taxes on anything they own.​

We were going to be in the pathway of a similar road (although way longer - for truck traffic) and people fought and had hearings and eventually the plan to build that road was abandoned.

So people resisting actively does help some times. Of course there were lots of properties at stake so lots of people fighting against it which I am sure makes things easier than when you are the only one affected.

Will it go through any other properties?

I'm still trying to find out more info on this and there is so much legalese involved -- I think we need to talk to a lawyer who understands the situation and the local laws. Basically, the road would be added to the deed, but only IF it is ever sold. But in another sense, that is a crock of sh** because even though we wouldn't sell it n our lifetimes, I think it would prevent any farmer from ever wanting to buy it in the future and would essentially force it to be sold for a development.

Karin, it will go through 1 or 2 other properties, but at the edges -- mostly it affects us.

Well remember that some things just aren't easy to move or better yet people aren't likely to move them. One of those being a cemetary. One person laid in the ground at the corner of your property or near the fence line would kill their plans cold. A pet cemetary would get alot of public attention if it got moved also. Not a conventional idea but better than losing your land and having trucks going by all day dumping fumes, oil and whatnot on your now bordering fields....
