It looks like a fledgling to me. Usually they leave the nest around this age and learn to fly while the parents keep an eye on it. It's always best to leave fledglings alone and watch for the parents from a far if you think it's been abandoned. It's very possible that the parents were killed or the baby got to far away from it's parents though.
It's illegal to keep them and try to raise them yourselves so I would get it to a wildlife rehabber. They will know how to care for it and properly release it back into the wild where it should be.
You won't be able to tell the gender until it's much older.
