I do have a serious issue with charging boys with rape charges... IMHO, it's not rape if they're both willing. They're stuck on the rape list for the rest of their lives and I think thats wrong. Especially when girls lie about their age etc.... Charge them with something akin to rape if you want, make up something new, but that is NOT rape IMO.
There is a saddening number of rape cases that go unreported and that are not taken seriously because of the "they were willing" mindset. Using words and actions to constantly pressure someone into having sex is up for debate as to whether it constitutes rape or not.
If someone, like a teenager, is constantly under pressure from the person who wants to have sex with them, and under pressure from their peers, they are likely to give in to having sex, regardless of if they want it. You throw their ages into the mix and you suddenly have one or two people who are, by law, unable to make sexual decisions for themselves and then most will agree that rape has occurred.
A lot of teens who are raped don't bother to report it because that will cause their peers to shun them and bully them. The very same reasons apply to why a lot of teens regrettably have sex at such an early age. Yes, there are teens and adults who will call rape when they are upset, but the actual numbers of that are small. A lot of rapists get away with the crime because the legal system goes around the rules and makes the victim look like a harlot.
These boys will have the rape charge follow them regardless of if they are convicted. Girls who are raped are followed all their lives by the damage that comes with rape.
This girl's family will have to live knowing their daughter commit suicide because these bullies tormented her, and now new bullies are tormenting them in their mourning.
Rape has a much bigger impact then a sexual action. I don't really want to get into it here, but the consequences for rape are very uneven for the victims and those accused of rape.
