Just checked it out on their website. It is definitely yours. Sorry about that. You have some beautiful birds and no one has the right to claim your pics. I love my sebbies too and would hate to have anyone steal my pics of them.

I'm so sorry this happened to you. In less than 6 months, our farm pictures 6 different times that I know of were taken by other sellers.... It's just wrong...Even my wording taken... and photoswith watermarks..... I hope this comes to an end for you. I didn't know about it, but was notified by friends on BYC and another board that had seen them. It's not only taking the picture but misrepresentation to the potential buyer..... I wish I had the time to search craigslist and fleabay and other sites to see if how many other photos were taken. Then I would try to get a probono attorney to file for damages and misrepresentation.....I've been lied to by folks on the phone (no shock right if they were thieving already), I've been cursed to on an email, I've been told that Photos were the property of all, etc, etc, On the plus side I was able to get money back for several people who bought eggs thinking they were from our farm because our LOGO was visible for the world to see....

Well I have neither much free time or research time, but I have a very good brief e mail you are welcome to use should you want to send a clear and certain message to the individual(s). Pm me if you would like a copy. Actually it would probably be best to send return receipt requested because then you know they got it and read it...

I just called La Caille Ranch since I haven't gotten a response from the 2 emails I sent them.
The person I talked to tried to tell me all the Sebastopols on their website were theirs!
I told him, "UM, NO, the Sebastopol in the gold frame is my photograph!"
I also pointed out to him that they have a copyright notice on their website so he
must be aware of copyright laws and he said "well no I don't"

I told him at any rate you don't use their people's photographs without first
asking for permission or paying them and to remove my pic ASAP.
He said he would. We'll see.

I filed a copyright infringement claim against them with their website's server.

I know these people, well did know them...... That is Where I got Cybil ( my turned up nose Sebbie) and my departed Sabastion ( the one that came down with lead poisoning) along with my 2 deformed leg Black swans. They shouldn't need anyone else s photos, When my Husband was over there he took many a beautiful pics of their birds and then gave them the pics... Afterward we had problems with our birds and disagreements with them.... .
