Tell him this... I pack my eggs with great care but cannot guarantee hatch rate due to unknown factors such as USPS treatment of package, inclement weather, and incubation method. If not satisfied with replacement eggs at buyers shipping expense then I will have no other option except to resolve this issue through the Ebay Resolution Center.

You'll have the leverage then. Ebay will definitely look into his past dealings. You have other sellers on your side.
