i would be sure to tell him you will be leaving negative feedback if he can not resolve the situtation. this may convice him to work with you. if not leave the feedback so he can not do this to someone else...

I would never do that to anyone..and then just say sorry bout that.
He just does'nt care...in it for the $$$ only...Thats the difference between those sellers and BYC sellers we care about all our chickies and chickies to be and all our BYC family.. I think I will just stick to BYC you all have always come through for me when I had a crisis..guess we have to learn the hard way sometimes to appreciate what we have

Oh!!!.... I did tell him I would leave neg. feedback if we couldnt resolve this I pleaded with him "just send me more eggs" he said NO!..but when I crack the last 4 opened and they were'nt fertile then I was mad.
I paid through paypal the payment has already been taken out...and It is in ebays hands now ...he has refused to concede anything. Just keeps saying NO REFUND! NO EGGS!
Those eggs look rotten not just unfertile, I'd claim against them too. If they are maran eggs the color will wash off. I had a bad experience on ebay too but I'll call her out by name "cluck_duck_goose" took my money for 3 auctions and ran I had to file a claim with the credit card company because it was past 45 days glad it wasn't past 60 days. Get your claim in fast there are good sellers out there don't let 1 bad egg ruin your good hatching.
Not really my place to say but the packaging didn't look that good... I didn't see any bubble wrap and they look like they were shipped in Carton? That is the easiest way to break an egg.... PPL need to learn from the pros how to get this done.. BUBBLE WRAP... each individual egg and lots of space with packing peanuts between... I have never had a breakage yet...
I just got 2 doz eggs today not a one broken from a seller last hatch was 31 out of 36 pretty good I think better yet his birds are great (meaties look like a red ranger some have turken) they are huge at 3 weeks I tried 1 doz went back for more. Not all egg sellers are like that one thank goodness. Keep on EBAY or you''ll lose your money and that's not right. I'd give bad feed back now help out somebody else who might have the same thing happen.
Try incubating the eggs - you never know your luck.
As for damage to goods - any seller will try his/her very best to remedy the situation.
Shipping involves third parties but your the client at the end of the day and any business that plans to grow needs to take care of all their clients - not just the hassle free ones.
Contact Ebay, lodge a dispute on PayPal, etc. All the techniques should get them to be more co-operative
