Silkie Roo ?

I think I already know the answer to this but want to get confirmation from all you smart chicken people before we get rid of one of our Silkies. We are not allowed to have roosters in our town and I promised my neighbor that we were not getting any but early this morning my husband heard it, the dreaded call of the wild from the back yard. I am attaching a few pics for you all to see. The first pic is of the two of them together. The second pic is of the one I am almost positive is the hen and the third is the one I think is the rooster. I apologize about the pics but they were being camera shy and are grumpy in the heat today.
