Nikki - I would be furious as well. I think I would tell her that I was questioning the quality of her birds, but her integrity is starting to speak for itself. And I'd be glad to return the bird as soon as she sends the refund plus shipping and handling for the bird. This was HER mistake. Remind her of that and go ahead and tell her that if she isn't willing to make her mistake right then you will start a complaint through PayPal and they will help you. AND if that doesn't get her motivated then I would follow thru with PayPal AND I would tell her that you have many folks on BYC asking who in the world she is so that we don't buy from her - you may be inclined to share her name and email address. Now that's just my opinion, I don't take to kindly to people who take advantage. She sold you a poor pet quality bird and it seems to me that you paid for top show quality. It is her fault she's in this mess but I don't think it was a mistake. I think she knew what she was sending you and she didn't care. If I'd made that terrible mistake, I'd be very quick to make it right and I would be most apologetic. So, this is just my 2 cents and the way I'd probably handle the situation. Not saying that is the best way, maybe someone else will have a better idea but it makes my blood boil and I'd be speaking with my temper. You know, she'd be lucky to have you keep her cross beaked bird. I've had one little bantam like that and I gave it away to someone as a pet. I certainly wouldn't breed it as it is either genetic or caused from a virus - either way it's not a good thing to have. Do your research, find some articles online and send them to her. You may need them for a PayPal complaint anyway. I'd be proving to her that she is wrong on all accounts.

She can refund you $50 but cannot go ship a new bird? I understand wanting her bird back, sort of. However I do NOT understand why she is putting that expense on you.

If I sold a bird and the customer was not happy because of an error by me, I would have done anything possible to make it right. I am a witch sometimes, but cannot stand the thought of making an error like that.

If you ask me, you weren't questioning her integrity, just asking her to make HER error right.

Sorry, I was already in bed last night when this came through.

OMG! That is terrible! First she "accidentally" sent you a defective bird and then wants you to ship her back (and I would at HER expense) or go ahead and put those defective genes into you gene pool. It would cost you $50 to send her back! How crazy is this person and then to say you questioned her integrity!!! Dag gone tootin' I would question the integrity of a breeder that had not already culled a defective bird and sold one on top of that!

PayPal may not help you but I would file anyhow because you were sent defective merchandise! You paid for a product that should have come in good shape and it didn't! I do not understand about the 45 days unless you had paid for them and it took that long to get them from the breeder, which would have been big warning bells anyhow. I know the heat has been bad lately so I am surprised that they were even shipped. My 2 PO won't let me ship any live birds out right now.

It doesn't matter who her other customers are because if they are just locals it means nothing to someone who may be a better breeder than herself. That sentence doesn't even warrant reading, imo. And if she is getting a cross beak chick for every hundred then she better rethink her breeding program. I have hatched and raised well over a hundred a month (usually closer to 400 at my peak hatching season) for several years and I haven't gotten it on but 2 chicks! I have hatched out Silkies right along with many other breeds and not gotten on any of the Silkies. And when X-treme Poultry out of TX sent me a cross beaked SLW I pitched a fit with them. But they are a pathetic excuse for a chick distributor anyhow and I lost most of their chicks. They never reimbursed for anything either.

If it were me, I would keep the pullet (unless she is willing to pay shipping back and she should since she sent defective merchandise!), take the loss and tell everyone in private (BYC frowns on telling what happens to you from another person on BYC) and consider it a lesson learned. I would not want her to get this bird back to sell to someone else. I am sure you could find someone wanting a pretty little pet. Depending on the severity of the cross beak, she probably won't live too long. Her skull is actually what is deformed and as it rotates throughout her life it will slowly kill her. Some folks believe you can trim the beak to get it correct and it may help for a short while but it will never stop rotating. I had one for several years. He was a sweet pet and I made his life as good as possible while he was here but soon his skull could not take the pressure and he had to be put down. It was a sad thing to watch happen to him.

Sorry you are having to go through this. Please keep us informed.

I know BYC frowns upon "bashing" people. And hope I haven't crossed any lines, or hurt any feelings. I was just so upset over the whole incident, and had to share my frustrations with my chicken family. If anyone wants to know whom she is, I'll be glad to pass that information along in private.

RE the bird: I gave her away a few weeks ago. The lady was wanting a silkie (bantam eggs) for her hand painted egg hobby. She seemed really nice, and I gave her the bird.

I'm thinking I will have to chalk this up as a lesson learned, and a good deed done. As, I will not be returning the bird, so she can add it back into her breeding program.

I have seen this woman's website before.
When I went to the link you shared and enlarged the photos I could see a crossed beak bird in the photo! It is standing on the planter. And she didn't NOTICE!!! Excuse me, if you handle a bird for a photo shoot and are a decent breeder then you know. You can better believe I will spread the word my own self. I am pretty sure she sells here on BYC. This is unacceptable!

Nikki, if there are any hurt feelings, it is yours. You were the one taken in! You have handled this way better than I would have, I can tell you that. When I feel I have been done wrong, my big mouth is going to share, as many of you know when I have been shoodooed over eggs not sent correctly to me.

I am still here...and welcome to the newbies..and the GA one

I have been trying to work diligently with our water situation here....so the chickens i have have just had to behave and be nice for the time being.
I was reading here..or another thread topic.......how does one know or see when the hens begin to show interest in being broody? Or, does egg laying mean broody? We have the one chicken tractor set up, but only with the 2 levels. It has roosts, covered and ventilated spots, lots of chicken wire and fencing (already went through the "Lab Test" of 2 young 1 yr old labs), but we haven't got to the building of nesting boxes yet. The chicks are still young.....12+ weeks perhaps.

Anyway, I saw somewhere that the hens start making noises(?) of some sort? And digging in the dirt, making holes? I have 2 hens all fluffy and fatter, talking to me...

Just a green chicken wrangler here....any ideas?

You can stop trying with Paypal. I bought two dozen lav Ameraucana eggs on Ebay earlier this year and paid by Paypal. They were not cheap. The seller kept saying "next week..." blah blah blah. Finally stopped hearing from him. I filed a complaint with Paypal but it had been longer than 45 days and they wouldn't do anything about it. Neither would Ebay. You can't even file a complaint with Ebay for nonreceipt after 45 days. The seller strung me along just past that point. Lesson learned.

Nikki, My advice to you is this: let it go. You can't win. Hopefully this silkie will end up adding something to your flock. Try breeding her and if the crossbeak shows up in the chicks, sell her. You can always sell a silkie for something. You might get lucky and it won't. Is she good type otherwise? Why make yourself crazy over something that won't change? Just accept that she sucks and you got screwed and move on. You might end up loving the silkie. She's totally in the wrong but she doesn't care and she's probably not going to make it right.

Of course, if you have her address, maybe we can all get together and make a stealth trip to egg her. I'm sure we all have some eggs to spare! Sorry it happened to you!

Happy Sunday! I talked to my husband last night and he's safe in Honduras.

I do not see your feedback on her sale. She has 13 positive feedback comments, and no negatives. this would definately be a negative

If you do not post a negative feedback, you could be "contributing" to someone else being taken. This defect should have been at leadt disclosed to the purchaser BEFORE the transaction was completed.
