Message from the rescue's lawyer to ours:


I represent XXXXXXXXX, a nonprofit animal rescue who has saved hundreds of dogs from euthanasia, neglect and abuse.
We want to ensure Tucker is in a safe and loving home that is a right fit for the O’Briens and for Tucker.
I am hopeful we can resolve this issue amicably taking the interests of Tucker first. I am sure you understand.

Thank you for clarifying the representation issue.

I agree that an amicable resolution is preferable.


I know that you have devoted much of your legal work in support of the well being of animals. You should know that, in addition to representing clients whose dogs are incarcerated or on death row or in custody disputes, I am a dog trainer who has trained many many dogs. I also have acted as an expert witness in a number of dog cases where a dog's life and liberty was at stake.


Yesterday, I met with the O'Briens and Tucker and saw how happy and trusting Tucker was with them. I understand that, due to the abuse he suffered from previous male guardians, Tucker was fearful of Mr. O'Brien in the early stages of their relationship. Now, with lots of love and even more patience on Mr. O'Brien's part, Tucker has developed a warm and playful relationship with Mr. O'Brien.


As you are probably well aware, dogs don't lie, even though people sometimes do. If there were any signs that Tucker was less than happy and trusting with the O'Briens, I would have seen it. Instead I saw a well cared for, well-adjusted fun loving dog who has bonded well with his guardians.


In sum, I believe that the O'Briens are kind and loving guardians for Tucker and that he is, and will continue to be, best served by staying with them.


I would be happy to speak with you about this further. Today, Sunday, is unlikely as I have meetings scheduled all day. Tomorrow, and later in the week I could speak with you. Would tomorrow at 11 a.m. work for you? If not, please suggest some times that you are available.

The whole thing is just ridiculous. Animal lovers or not, they are wasting time and money that could be better spent in their rescue efforts.

I stay away from those kinds of organizations, and this is a perfect example of why I do.

I am sorry you have to deal with this nonsense, too!

If they insist on going to court - and if they lose, will they have to pay your expenses (lawyer, time, etc)? They should!

You not only have a good attorney here; you have a good dog person. Do exactly what he says , and do not be drawn into this nutcase "rescue society's" claims.Married to an attorney for 21 years , and on rescue/humane society boards forever.....
